Per Mr. Bipin Gupta, J:
1. By way of these writ petitions, a common issue has been
raised by the petitioners, therefore, with the consent of all the
parties, all the petitions are heard together and are being
disposed of by this common order.
2. Brief facts as stated in a bunch of writ petitions being led by
D.B. Civil Writ Petition No.11737/2024 are that the petitioners are
individuals who joined the services as “Data Entry Operator/
Computer Operator” through placement agencies under the
Mahatma Gandhi National Rural Employment Guarantee Act
Scheme (hereinafter referred to as ‘MGNREGA Scheme’) against
posts created under schemes by Administrative Department with
the concurrence of Finance Department. The respondent State
thereafter promulgated the law governing the contractual
employees in order to regulate the services and thus for the said
purpose, a notification was issued on 11.01.2022, whereby, the
rules namely Rajasthan Contractual Hiring to Civil Posts Rules,
2022 (hereinafter referred to as the ‘Rules of 2022’) were
promulgated.
3. The case of the petitioners, at the outset, is that having been
appointed on contractual basis under government schemes, the
petitioners must be declared as covered under the Rules of 2022
by harmoniously reading Rule 3 of the Rules of 2022 or in

vires as being violative of the principle of equality enshrined under
Article 14 of the Constitution of India. The respondent Authorities
have arbitrarily and without any intelligible differentia has
discriminated between the contractual employees working under
schemes having been appointed through two different modes, i.e.,
one by the Government directly on contractual basis and another
through placement agency, on contractual basis.
4. Learned counsel for the petitioners submitted that the mode
of appointment cannot be a ground to deny benefit of the Rules of
2022 as framed by the respondents. Counsel further submitted
that the petitioners carry out the same nature of work and duties
therefore they are at parity with the contractual employees who
have been working under the scheme on contractual basis
employed directly through the Government.
5. Learned counsel for the petitioners further submit that as per
Rule 3 of the Rules of 2022, per se there is no distinction between
the employees appointed on contractual basis either through a
placement agency or directly through Government. Further, the
said Rule provides that the same shall be applicable only to the
posts created by the Administrative Department with the
concurrence of the Finance Department and that the selection to
the said posts ought to have been made on the contractual basis
only after inviting applications through public advertisement.
Learned counsel for the petitioners thus submitted that the
petitioners have been selected and appointed to the posts created
by the Administrative Department with the concurrence of Finance
Department and the said selection was duly made by way of

inviting applications through public advertisement. Therefore, the
petitioners are covered under Rule 3 of the Rules of 2022.
6. Learned counsel for the petitioners, in the alternate,
submitted that if the petitioners are found not covered under the
ambit of Rule 3 of the Rules of 2022, and the said benefits are
only applicable to the individuals who have been selected by the
Government directly through public advertisement and not to
those who have been appointed through any inter-mediate
employer, i.e. a placement agency, then in that circumstances,
Rule 3 of the Rules of 2022 may be declared as ultra vires and
violative of Article 14 of the Constitution of India and against the
objectives laid down in the Preamble to the Rules of 2022.
7. Learned counsel for the petitioners while referring to the
Preamble to the Rules of 2022 submitted that the Departmental
Schemes/Projects/Central Sponsored Scheme/Projects undertaken
by the State Government for social and economic development,
require specialists, experts and man-power for its effective
implementation and the post for such do not exist in any other
Service Rules in the Government for regulating appointments and
conditions of service of such posts. Therefore, to regulate the
services which are not against any regular post and are not
governed by any Service Rules are required to be covered under
the Rules of 2022. Counsel for the petitioners thus submitted that
the distinction made by the respondent Authorities without any
intelligible differentia is therefore prima facie arbitrary and
discriminatory and contrary to the object of the Rules also.
8. Per contra learned counsels for the respondents have
contended that since the petitioners have not been appointed by

the Government directly on contractual basis but through
placement agency, therefore they are not covered under the ambit
of Rules of 2022.
9. Counsel for the respondents further submits that, since no
advertisement was issued prior to the appointment of the
petitioners through the placement agency, the pre-condition as
required under Rule 3 of the Rules of 2022 has not been complied
with. Therefore, the petitioners do not fulfill the said mandatory
condition and, as such, cannot be covered under the Rules of
2022. It has been further argued by the respondents that the
rules are neither beyond the legislative competence nor are
against the fundamental rights. It has been further argued that
the necessary ingredient under Rule 3 is appointment through
public advertisement and thus categorization is having an
intelligible differentia which cannot be said to be discriminatory. In
support of his submission learned counsel for the respondents
have relied upon the judgment passed by Hon’ble Apex Court in
the case of Bharat Heavy Electricals Ltd. Vs. Mahendra
Prasad Jakhmola & Ors.; (2019) 13 SCC 82 to buttress their
case.
10. Learned counsel for the petitioners in rejoinder to the
arguments advanced by the respondents submitted that there is
no word under Rule 3 of the Rules of 2022 which prima facie
excludes the persons appointed on contractual basis through
placement agency. Thus, the interpretation adopted by the
respondents is misconceived and contrary to the existing Rule 3 of
the Rules of 2022.

11. Learned counsel for the petitioners, in support of his
contention, has placed reliance on the judgment passed by the
constitutional Bench of Hon’ble Apex Court in the case of
Mangalore Ganesh Beedi Works Etc. Vs. Union of India; AIR
1974 SC 1832 wherein the issue before the Court was that who
would be the principal employer or real master in case of an
employee appointed through a contractor in a manufacturing
industry. While specifically dealing with the challenge to provisions
of Beedi and Cigar Workers (Conditions of Employment) Act, 1966,
the Hon’ble Apex Court held as under:-
“37. The contention on behalf of the petitioners and the
appellants is that in common law a person cannot be made
responsible for actions of an independent contractor and
that he should not be penalised for the contravention of any
law by an independent contractor is to be examined in view
of the language employed in defining the expressions
contract labour, contract, establishment, employer and
principal employer. It was particularly said that when home
workers wore given tobacco and leaves directly by the
manufacturers the home workers would not be under their
control and the manufacturers should not be made
responsible for providing any amenities or leave facilities for
those home workers.
40. The present legislation is intended to achieve welfare
benefits and amenities for the labour. That is why the
manufacturer or trade marks holder becomes the principal
employer though he engages contract labour through the
contractor. He cannot escape liability imposed on him by
the statute by stating that he has engaged the labour
through a contractor to do the work and therefore he is not
responsible for the labour. The Contractor in such a case
employs the labour only for and on behalf of the principal
employer. The contractor being an agent of the principal
employer for manufacturing beedis is amenable to the
control of principal employer. That is why the statute says
that even if the contract engages labour without the
knowledge of the employer the principal employer is
answerable for such labour because the labour is engaged
for or on his behalf. The act and the Rules thereunder
prescribe maintenance of log books and registers. Where
the manufacturer or the trade mark holder engages labour
directly, the manufacturer maintains registers and lo books.

Where the manufacturer engages contract labour through a
contractor the manufac- turer will require the contract or to
maintain such log books of the contract labour and through
such books and registers win keep control over not only the
contractors but also the labour.
41. The principal employer is the real master of the
business. He has real control of the business. He is held
liable because he exercises supervision and- control over
the labour employed for and on his behalf by contractor.
The benefits of the welfare measure reach the workmen
only by direct responsibility of the principal employer. The
basis of the welfare measure is in the interest of the
workers with regard to their health, safety and wages
including benefits of leave and family life. The Bombay High
Court and the Kerala High Court struck down the provisions
contained in sections 2(g) (a) and 2(m) of the Act in regard
to the principal employer being liable for contract labour as
an unreasonable restriction on the manufacurer’s right to
carry on business. This view proceeds on the basis that the
principal employer is liable for acts of the independent
contractor. The Actdoes not define an independent
contractor, nor mention the independent contractor.’ The
Act speaks of the principal employer in relation to contract
labour and employer in relation to other labour. When a
contractor engages labour for or on behalf of another
person that other person becomes the principal employer.
The Attorney General rightly said that if it were established
on the facts of any particular case that a person engaged
labour for himself he would be the principal employer of
contract labour. In such an instance there is no question of
agency on behalf of another person.”
12. Learned counsel for the petitioners also placed reliance on
the judgment passed by the Hon’ble Apex Court in the case of
Hussainbhai Vs. The Alath Factory Tezhilali Union & Ors;
AIR 1978 SC 1410 wherein the principle regarding the employer-
employee relationship and the fact that who shall be the principal
employer, has been reiterated by the Court.
13. Learned counsel for the petitioners further relied on the case
of Jaggo Vs. Union of India & Ors.; AIR Online 2024 SC 870
wherein the Hon’ble Apex Court has deprecated the appointment
of contractual employees by the Government Departments as the

long contractual employment leads to contravention of
International Labour Standards which in turn also exposes the
organization to legal challenges and undermines the morale of the
employee. The Hon’ble Apex Court while reiterating the said
position stated that by ensuring fair employment practices,
Government Institutions can reduce the burden of unnecessary
litigation, promote job security and uphold and embody the
principles of justice and fairness in the system. The said approach
aligns with International Standards and also sets a positive
precedent for the private sector to follow, thereby contributing to
the overall betterment of the labour practices in the country.
The relevant paragraph of the judgment is reproduced herein
below:-
“28. In light of these considerations, in our
opinion, it is imperative for government departments to
lead by example in providing fair and stable
employment. Engaging workers on a temporary basis
for extended periods, especially when their roles are
integral to the organization’s functioning, not only
contravenes international labour standards but also
exposes the organization to legal challenges and
undermines employee morale. By ensuring fair
employment practices, government institutions can
reduce the burden of unnecessary litigation, promote
job security, and uphold the principles of justice and
fairness that they are meant to embody. This approach
aligns with international standards and sets a positive
precedent for the private sector to follow, thereby
contributing to the overall betterment of labour
practices in the country.”
14. Learned counsel for the petitioners have also relied upon the
judgment passed by this Court in the case of Mitendra Singh
Rathore & 121 Ors. Vs. State of Rajasthan and Ors; 2013
(4) WLC (Raj.) 523, to buttress their claim and arguments.

Lastly, learned counsel for the petitioners submitted that the
contractual employees appointed through the placement agency in
the schemes/projects, through placement agency may be covered
under the Rules of 2022 or in alternate, the rule may be declared
as ultra vires and discriminatory as it violates the principles of
equality enshrined under Article 14 of the Constitution of India.
15. Heard the learned counsel for the parties and perused the
paper-book of the writ petition and the judgments cited by the
counsel.
16. The following questions arise for consideration of this
Court :-
(a) Whether Rule 3 of the Rules of 2022 has to be read
harmoniously in a manner to include the persons appointed
on contractual basis through the placement agency or not?
(b) Whether Rule 3 of the Rules of 2022 excluding the
persons appointed on contractual basis through placement
agency discriminates petitioners and therefore violates
Article 14 of the Constitution of India?
17. Before adverting to decide the issues as framed in Para 13,
this Court deems it appropriate to refer the order dated
21.05.2024 passed in one of the connected writ petition
No.4597/2023 whereby following questions were framed and the
reply was sought from the respondents;-
“1. Learned Additional Advocate General is directed
to respond the following points:-
a) Whether the petitioners entered into the arena of
service strictly in accordance with the norms laid down
by the State Government/placement agency.
b) Whether the petitioners were having necessary
eligibility or qualification required for the post.

c) Whether prolonged employment of the petitioners
gives them a right to be treated at par with other
contractual employees.
d) whether the petitioners, who have prolonged
service record, have discharged the same duties as
that of similarly situated contractual employees holding
the same post.
e) whether the State has any scheme to regularize
the persons entered into the service in accordance with
the norms of the State and have entered the service
with the same job chart for the same working hours
and for the same tenure as that of the contractual
employees.”
18. In response to those questions, an affidavit was filed by the
respondent – State whereby following was replied by letter dated
16.07.2024:-

19. Perusal of the reply indicates that the respondent admits the
fact that the petitioners had entered into the services strictly in
accordance with the norms laid down by the State Government/
placement agency.
20. Further, the State admitted the fact that petitioners were
having necessary eligibility/qualification required for the post.
Moreover, the respondents have even admitted the fact that the
person employed through placement agency as well as the person
employed by the State directly under contractual employment
carry out the same nature of work and duties. However, in the
same breadth, in spite of the three admissions as indicated above,
the respondent – State has denied the benefit of the Rules of 2022
to the petitioners on the basis of the departmental letter dated
05.01.2023 whereby, the contractual employee appointed through
the placement agencies were decided not to be considered under
the Rules of 2022 and only the persons appointed on contractual
basis directly through public advertisement were to be considered.
21. In light of the affidavit filed by the respondents, this Court
deems it appropriate to evaluate the scheme under the Rules of
2022. By promulgation of Rules of 2022, the State Government
had taken a decision to deprecate the practice of hiring the
persons on contractual basis and the persons who were already
working on contractual basis have been brought under the Rules
to be regulated by the same. Under the scheme of the Act, after

the implementation of the Rules of 2022, hiring on contractual
basis has to be done according to the procedure provided under
the said Rules.
22. Further, there is nothing in the Rules which states that the
persons already hired on contractual basis in accordance with Rule
3 under the schemes, prior to the implementation Rules of 2022,
are to be discharged.
23. However, the State in its reply had denied the benefit of the
Rules of 2022 to the petitioners on two counts, one that the
petitioners have been appointed through the placement agency,
and secondly that the petitioners have not been appointed through
issuance of a public advertisement.
24. This Court is of the opinion that according to Rule 3, the
necessary consideration for application of Rules of 2022, is per se
that a person should have been appointed under the scheme. Rule
3 of Rules of 2022 is reproduced as under:
“3. Scope and application. – These rules shall apply
to posts created by the Administrative Department with
the concurrence of the Finance Department for
implementation of any project or scheme and to person
appointed on such posts in accordance with the
provisions of these rules or person working on the post
so created on contract basis on the date of
commencement of these rules provided his/her
selection was made after inviting applications through
public advertisement.”
25. Under Rule 3, four conditions are necessary for application of
the Rules of 2022. Firstly, that the post has to be created by the
Administrative Department; secondly, there has to be concurrence
of the Finance Department; thirdly, the individuals should have
been selected by inviting applications through public

advertisement, and fourthly, the individual working on the post
must be on contract basis. Under the said Rule, there is per se no
differentiation between the contractual employees who have been
appointed either by the government or through the placement
agency. The Rule does not categorize such contract as either direct
or indirect contract.
26. Undisputedly, the petitioners and similarly situated persons
have been appointed admittedly on the post created by the
Administrative Department with the concurrence of the Finance
Department. They are working on contract basis. Therefore, the
contention of the respondents that the individuals appointed
through the placement agency will not be covered under the Rules
of 2022 is without any force as Rule 3 of the said Rules does not
contemplate the same. So far as the condition that the individuals
ought to have been appointed after inviting applications through
public advertisements is concerned, the reason behind the same is
likely to prevent back-door entries since public advertisement
provides equal opportunity for everyone to participate in the
process by applying for the post.
27. It is pertinent to note that in some of the cases as argued by
the petitioners, the placement agency had duly issued an
advertisement and thereafter the petitioners have been selected.
Thus, the individuals who fulfill all the four conditions required
under Rule 3 of the Rules of 2022 cannot be discriminated merely
on count of the fact that they have been appointed through a
placement agency.
28. The appointment of the employees through a placement
agency by the State Government appears to have been made with

an intent to avoid any liability that could have arise on the State
due to such employment. However, a Constitutional Bench of the
Hon’ble Apex Court in the case of Mangalore Ganesh Beedi
Works (supra) held that in light of welfare legislation, the liability
could be imposed on the principal employer even if the employee
has been appointed through a contractor.
29. Relying upon the said judgment, this Court is of the opinion
that the Rules of 2022 are in nature of welfare legislation which
has been framed by the State to deprecate the practice of the
Departments to appoint contractual employees without their being
any regulations to govern them and further with an intent to
ensure that the employees who have been working on contractual
basis are brought within the purview of the said rules. Moreover,
the Rules of 2022 had been given a retrospective effect as it has
been intended to cover even those employees who have been
working on contractual basis as on the date of enforcement of the
Rules of 2022. By such rules, the unregulated employment is
made into regulated employment.
30. In light of the judgment rendered by the Hon’ble Apex Court
in case of Mangalore Ganesh Beedi Works (supra), the denial
of benefit of the Rules of 2022 to the petitioner and other similarly
situated persons having been appointed through placement
agency is not sustainable. Thus, the interpretation of Rule 3 of the
Rules of 2022 as done by the respondent-State Government by
way of reply as well as the instructions issued by the employers is
an incorrect interpretation against the intent and object which are
sought to be achieved by the Rules of 2022. If such interpretation
is drawn, it would amount creating two classes from one class.

The legislation intends only one class i.e. contract employee. If
such classification is allowed, it would amount creating classes
within class and such classification defeat the legislative intention.
31. Moreover, the respondents cannot discriminate against the
employees appointed through placement agency, if they fulfill the
conditions as provided under Rule 3 of the Rules of 2022 which
specifically states four conditions only, as enumerated in earlier
part of this judgment. Therefore, the petitioners and similarly
situated persons ought to be considered for the purpose of
coverage under the Rules of 2022, if they fulfill the conditions i.e.
post has been created by the Administrative Department in
concurrence with the Finance Department and the appointment
has been made through public advertisement. If the appointment
has been made pursuant to a public advertisement, whether
through the placement agency or directly by the Government, the
same cannot be differentiated merely on count of having been
appointed by the placement agency and thus, the action of the
respondents cannot be countenanced by denying the benefits of
the Rules of 2022 to the employees who have been appointed
through placement agency in spite of fulling all the conditions as
required under the Rules of 2022.
32. The Rules of 2022, being a welfare legislation, intends not
only to regulate the persons who will be appointed in future on
contractual basis but also applies to those persons who are
already working on contractual basis as on the date of of the
rules.
33. The object of the Rules of 2022 enforcement, is reproduced
hereinafter:-

“Whereas the State Government in public
interest undertakes departmental Schemes
/Projects/Central Sponsored Schemes/ Projects for
social and economic development as a welfare State.
For implementation of most of these projects/
schemes requires the subject matter specialists,
experts and manpower and posts for which do not
exists in any other Service Rules in the government
for regulating appointments and conditions of service
of such posts. By their very nature the development
schemes/projects undertaken by the Government are
usually required for short term or medium term.
Therefore, State Government needs to allow such
posts to be filled in by way of hiring persons on
contract basis in the State Government.
Now, therefore, in exercise of the powers
conferred by the proviso to Article 309 of the
Constitution of India, the Governor of Rajasthan
hereby makes the following rules, regulating the hiring
of subject matter specialists, experts and manpower
on contract, and the conditions of the services of
persons hired to the Rajasthan Contractual Hiring to
Civil Posts Rules, 2022, namely:-”
34. The Court is of the firm opinion that the said Rules have
been framed with an object to regulate the contractual employees
engaged under various schemes by the State. The Rules of 2022
does not carve out a distinction between the employees appointed
on contractual basis either directly by the Government or through
a placement agency. However, by way of caution, it is clarified that
the persons who are appointed by the placement agency only
after inviting applications by way of public advertisement are to be
considered and not the persons appointed without there being any
public advertisement, as the absence of public advertisement may
lead to the back-door entries.
35. Further, this Court is of the opinion that the notification
promulgating the Rules of 2022 does not provide for any

substantive right to claim regularization and therefore, the
argument of the respondents that the contractual employees
appointed through placement agency cannot claim the right of
regularization as there is no privity of contract between the State
and employee is not tenable and the judgments cited on this issue
are not relevant for decision of the present controversy.
36. Further, the judgment of Bharat Heavy Electricals Ltd.
(supra) cited by learned counsel for the respondents has no
application as it was a case where employees of contractors
working in BHEL were not found to be employees of BHEL and
therefore, termination was found valid and reinstatement of
service award was set aside by the Hon’ble Apex Court. The said
case is not applicable in present set of facts. Furthermore, that
judgment has not considered the Constitutional Bench judgment
of the Hon’ble Apex Court in the case of Mangalore Ganesh
Beedi Works (supra).
37. The Rules of 2022 provides the manner in which the
appointments are to be made on contractual basis for a particular
period. Further, Rule 11 provides that the contractual appointment
shall stand terminated automatically on expiry of the period of
contract and there would be no requirement of issuing a separate
order for terminating the services.
38. On application of said rules, the State Government, in
respect of contractual employees working on the date of
commencement of these rules, is required to issue an
appointment order as provided under Rule 12 in the prescribed
form as appended to the Rules. However, the issuance of an
appointment order does not confer any right upon the employee to

claim the regularization. It is merely an appointment order on
contract basis for fixed term and therefore, the action of the
respondents to exclude the individuals appointed by placement
agency through public advertisement cannot be allowed to be
continued.
39. Further, the respondents in their reply or during the course
of arguments have not come out with a case that the services of
the petitioner and similarly situated persons working through
placement agency in the scheme is no more required, rather it
reflects that even after the promulgation of the Rules of 2022, the
petitioners and similarly situated persons appointed through
placement agency are carrying out their duties and it is not the
case of the respondents that the posts on which they have been
working are abolished by virtue of completion of the scheme under
which they were engaged. Therefore, when once the petitioners
and similarly situated persons are continuing on their posts under
the scheme, the State Government cannot deny to regulate their
service by applying the Rules of 2022, as with the implementation
of the said Rules, every contractual employee has to be regulated
by the Rules framed by exercising powers under Article 309 of the
Constitution of India who fulfill the criteria as given under Rule 3
of the Rules of 2022.
40. This Court is further of the firm opinion that if the
respondents continue with the services of the petitioners, without
covering them under the Rules of 2022 would be against the
principles as enumerated by the Hon’ble Apex Court in a catena of
judgments wherein the Court has opined that the practice of
appointment of contractual employees without any rules would

lead to a situation of exploitation by the employer. With this intent
only, the Rules of 2022 have been framed and therefore, the
benefit of the said rules cannot be denied to the petitioners and
similarly situated persons merely on the count of having been
appointed through placement agency.
41. In light of the aforesaid facts & findings and the judgments,
this Court is of the opinion that Rule 3 of the Rules of 2022 has to
be read harmoniously, whereby, the petitioners and similarly
situated persons, who have been appointed through placement
agency after issuance of public advertisement are to be covered
under the ambit of Rule 3 of the Rules of 2022. Since, the above
rule has been read harmoniously in favour of the petitioners,
therefore, there is no requirement to decide question No. (b),
which was framed under para 13. The harmonious reading of the
Rule itself clarifies that, there ought to be no discrimination
between the contractual employees appointed through placement
agency as well as the contractual employees appointed directly.
42. For the aforesaid reasons, the writ petitions are allowed in
the following terms :
(i) The respondents shall consider the individual case of each
contractual employee, appointed prior to enforcement of the Rules
of 2022 strictly in accordance with Rule 3 of the Rules of 2022,
meaning thereby, that if an employee has been appointed on a
post created by the Administrative Department with the
concurrence of the Finance Department and the appointment has
been through issuance of a public advertisement further without
there being any differentiation whether the public advertisement

agency.
(ii) If the case of the individual is in conformation with the Rule
3 of the Rules of 2022, as interpreted above, then the benefit of
the Rules of 2022 shall be extended to such petitioners.
43. All pending applications, if any, also stand disposed of.
