01. Central Government by virtue of a notification

No. 12012/36/2018-IR (B-I) dated 16.11.2018

referred an industrial dispute with respect to

termination of services of the respondent No. 2-

Manzoor Ahmad Kripak with effect from 05.03.2012

by the petitioner for adjudication under section 10 of

the Industrial Disputes Act, 1947 whereupon the

Central Government Industrial Tribunal-cum-Labour

Court-I, Chandigarh, passed an industrial dispute

award dated 21.03.2025 getting published under ID

No. 94/2018, whereby the respondent No. 2-

Manzoor Ahmad Kripak has been ordered to be
reinstated in service with all consequential benefits

and continuity of service with full back wages from

the date of his termination i.e. 05.03.2012.

02. The termination of the respondent No. 2 had

taken place as being Banking Attendant Code No.

22621 while posted at J&K Bank Branch Unit

Dulhasti.

03. Issue notice to the respondent No. 2 only.

04. Mr. T. M. Shamsi, learned Deputy Solicitor

General of India enters appearance on behalf of

respondent No. 3, who otherwise is not required to

contest the writ petition and being more a proforma

respondent. There is no need for the respondent No.

3 or for that matter even for the respondent No. 1 to

come forward with any response/reply to the writ

petition.

05. The petitioner to furnish registered postal

cover within seven days, whereupon Registrar

Judicial, Srinagar to issue notice to the respondent

No. 2.

06. Registry to send for the record of the case

titled “Manzoor Ahmad Kripak vs The Chairman, the

Jammu and Kashmir Bank Pvt Ltd & Ors” decided on
21.03.2025 from the Central Government Industrial

Tribunal cum Labour Court-I, Chandigarh.

07. List again on 24.09.2025.

08. In the meantime, subject to objections from

the other side and till the next date of hearing before

the Bench, the operation of impugned award dated

21.03.2025 shall remain stayed, without prejudice

to the right of the respondent No. 2 to invoke section

17(B) Industrial Disputes Act, 1947 provision.
