1. Leave granted.

2. The High Court of Judicature at Allahabad by the impugned judgment and

order dated 5th January, 2021 has refused the appellant’s prayer for quashing

of First Information Report1 No. 37 of 2020 dated 16th March, 2020 registered at

Police Station Gwal, District-Kanpur City inter alia under Sections 376, 354 and

120-B of the Indian Penal Code, 1860.

3. We have looked into the FIR, and the victim’s statements recorded under

Section 161 as well as Section 164 of the Code of Criminal Procedure, 1973 2.

We do not find any direct allegation against the appellant of he having either

raped/molested or even attempted to rape the victim. From the statement

recorded under Section 161, Cr. PC, what we find is that certain incidents

transpired while she was in the bungalow of the appellant but at the instance of

4. Having regard to such facts and circumstances, the FIR qua the appellant

stands quashed.

5. The appeal is, accordingly, allowed on the aforesaid terms.

6. Anything said in this judgment/order shall not influence the trial court

while it proceeds with the trial against the co-accused.

7. Pending application(s), if any, stand disposed of.
