1. The present petition is filed under Article 226 of the
Constitution of India challenging the order dated
03.01.2020 passed by the respondent under Section
8F of the Employees’ Provident Funds and
Miscellaneous Provisions Act, 1952 (‘the EPF Act’),
whereby the petitioner has been held personally
liable to pay the defaulted amount.

2.1. The petitioner was a Director of a company
named Taj Haberdashery Products Pvt. Ltd.,
engaged in the business of manufacturing zip
fasteners since the year 2000. The establishment
was duly covered under the provisions of the
Employees’ Provident Funds and Miscellaneous
Provisions Act, 1952 (‘the EPF Act’) and was
