1. Allowed, subject to all just exceptions.

2. The application stands disposed of.

W.P.(C) 13309/2025 & CM APPL. 54611/2025 (by petitioner under
Section 151 CPC seeking interim relief)

3. The present petition has been filed seeking following reliefs:

“a. Admit and allow the present Writ Petition and pass
appropriate Writ, order or direction in the nature of
Mandamus or of any other nature as deemed fit and
necessary by this Hon’ble Court, directing the respondents

to withdraw the detainees list dated 24.05.2025 (Annexure
P-1) issued by Respondent No. 3 insofar as it pertains to the
Petitioner herein; and/or
b. Pass appropriate orders or directions as deemed fit and
necessary by this Hon’ble Court quashing the detainees list
dated 24.05.2025 (ANNEXURE P-1) issued by the
Respondent No. 3 insofar as it pertains to the Petitioner
herein.”

4. The case set out by petitioner is that petitioner is a final year student
of three year LL.B. Course at the Law Centre-II, University of Delhi and he
was due to take his final semester examinations from 27.05.2025 as per the
admit card issued to him. However, by virtue of subsequent notification of
Detainees’ List on 24.05.2025, petitioner was debarred from appearing in his
sixth and final semester examinations.

5. Subsequently, on 27.05.2025, a notice [Annexure P-11] was issued by
the Head and Dean, Faculty of Law to the effect that all students who have
been detained due to shortage of attendance are being provisionally allowed
to sit in the LL.B. II/IV/VI term Examination scheduled to be held in May-
June 2025, subject to the final outcome of the deliberations of the Enquiry
Committee constituted to look into the aspect of short attendance.

6. Mr. K.C. Mittal, learned counsel appearing on behalf of petitioner
submits that the exams of sixth semester were commencing from 27.05.2025
but the notice was issued by the Head and Dean, Faculty of Law on
27.05.2025 only in the evening, as a result of which petitioner missed his
exam of ‘Professional Ethics and Accounting System’ which was scheduled
on 27.05.2025 in the morning. However, the petitioner had taken all the
remaining four exams of sixth semester.

7. He submits that the result of sixth semester has been declared by the
respondent no.1/University, however, the result of petitioner has not been
declared, apparently for the reason that he had not taken his first exam of
Professional Ethics and Accounting System.

8. He further submits that respondent no.1/University is now conducting
supplementary exams and the supplementary exam for the said subject is
scheduled to be held on 01.09.2025. To support his contention, he refers to
the date sheet of sixth semester supplementary examination, 2024-25 issued
by the University which is annexed as Annexure P-14 to the petition.

9. In view of the above, issue notice.

10. Mr. Mohinder J.S. Rupal, learned counsel appearing on behalf of
respondent no.1/University of Delhi accepts notice.

11. Let counter-affidavit be filed within a period of three weeks from
today.

12. Rejoinder thereto, if any, be filed before the next date.

13. Having regard to the submissions made by Mr Mittal, petitioner is
allowed to take supplementary exam of the paper titled, ‘Professional Ethics
and Accounting System’ which is scheduled to be held on 01.09.2025.
Accordingly, the respondent no.1/University is directed to issue admit card
to the petitioner for the said exam.

14. Mr. Rupal is also requested to ensure that petitioner is issued admit
card for the said exam.

15. Let result of supplementary exam of petitioner be placed by
respondent no.1/University before this Court in a sealed cover.

16. Needless to emphasize, interim relief granted to petitioner by way of
this order will not create any special equities in favour of petitioner.
