Heard learned counsel for the petitioner as well as
learned APP for the State.
2. The petitioner apprehends his arrest in connection
with Patliputra P.S. Case No. 145 of 2024, registered for the
offences punishable under Sections 323, 313, 386, 504, 494,
498A of the IPC.
3. According to the allegation, the complainant, who
is wife of the petitioner, was tortured for non-fulfillment of
dowry demand. It has further been alleged that the petitioner has
solemnized his second marriage.
4. In order to explore the possibility of restoration of
conjugal life of the parties, the matter was referred to the Patna
Patna High Court CR. MISC. No.67885 of 2024(7) dt.30-08-2025

High Court Mediation and Conciliation Centre. However,
neither the petitioner was ready to keep the victim, nor the
victim is willing to reside with the petitioner and the matter has
become irretrievable.
5. It has been submitted that both the parties want to
get their marriage dissolve through a decree of divorce on the
basis of mutual consent under Section 13B of Hindu Marriage
Act, 1955 and in this regard, a joint petition under Section 13B
has already been filed by the parties.
6. Considering the above-mentioned facts and
circumstances, let the petitioner, in the event of his arrest or
surrender within four weeks before the learned court below, be
released on anticipatory bail on furnishing bail bond of Rs.
10,000/- (Ten Thousand) with two sureties of the like amount
each to the satisfaction of learned S.D.J.M, Patna in connection
with Patliputra P.S. Case No. 145 of 2024 , subject to the
conditions as laid down under Section 438(2) Cr.P.C.
