Heard Mr. S.S. Yadav, learned counsel for the petitioner, who has
submitted that this application under Section 483 of the Bharatiya Nagarik
Suraksha Sanhita (BNSS), 2023 has been filed with a prayer for grant of bail on
behalf of the petitioner herein, who is an accused standing trial in connection
with Umsning P.S. Case No. 21 (07) 2023 under Section 21(c)/29 of the NDPS
Act, and which case on being charge sheeted and taken cognizance of by the
learned Special Judge (NDPS), Ri-Bhoi District, Nongpoh is registered as Crl.
(NDPS) Case No. 23/2023.
Mr. R. Gurung, learned GA has accepted notice on behalf of the State
respondent Nos. 1 & 2, as such, no formal notice is called for.
However, in course of hearing, it is noticed that the complete set of
charge sheet has not been annexed with the petition which would assist the Court

in dealing with this matter by referring to relevant portions of the findings and
observations made by the Investigating Officer, which has been duly noted down
in the case diary.
Accordingly, on prayer made by the learned GA, copy of the case
diary including the charge sheet is directed to be produced before this Court on
the next date.
As prayed for by the parties, list this matter for further hearing on
05.09.2025.
