Hindu Marriage Act (25 of 1955) , S.26— Custody of child – Visitation rights – Place for – Minor child was residing with mother at place ‘A” while father was resident of place ‘B’ – Distance between two places was about 150kms. – While father has right to visit child, it cannot be at the cost of child’s health and wellbeing – Though grant of visitation rights to the father was proper, Supreme Court found directions and set up to enable same to be adversarial to the child – Keeping interest and well being of child as priority, place of visitation was moved from place ‘B’ to place ‘A” – Directions were modified accordingly.
