Heard Mr. Romendro Sharma, learned counsel appearing for the

petitioner.

The order of the Family Court passed in Cril(Enhancement)Case No.1 of

2024 in Cril.(M) Case No.56 of 2009 dated 14.11.2024 wherein the Family Court

passed an order to enhance the sum of Rs.4,500/- to 10,000/- per month for the

maintenance allowances from the date of filing the application i.e. from the month of

11.01.2024 on or before the English Calander till further orders. The second leaf of

the order is that the respondent(petitioner herein) was directed to bear a sum of Rs.

1,47,741/- and thus directed the respondent(petitioner herein) to make a payment

of Rs. 1,47,741/- to the Petitioner No.2(respondent No.2 herein) through the

petitioner No.1(respondent No.1 herein) and the said aforesaid order dated

14.11.2014 has been under challenge in present petition and seeks for passing an

interim order.

Considering the submissions made by the learned counsel appearing for

the petitioner, a prima facie case is made out. Therefore, this Court is inclined to pass

interim order.

Therefore, this Court stays the order dated 14.11.2024 only in respect of

payment of Rs. 1,47,741/- to the Petitioner No.2(respondent No.2 herein) for the

period of 4(four) weeks and it is made clear that in so far as the maintenance

allowance is concerned, the petitioner has to comply with the direction of the learned

Family Court to enhance the sum of Rs.4,500/- to 10,000/- per month for the

maintenance allowances.

Notice to the respondents returnable by 8(eight) weeks. Private notice is

also permitted.

List the matters on 06.03.2025.
