1. Impugned in the instant writ petition filed under the provisions of

Article 226 of the Constitution of India, is the tentative selection

list, issued by the respondent No. 4-Zonal Education Officer,

Chamkote Karnah, Kupwara, bearing Order No. ZEOC/127-

32/23-24 dated 29.01.2024 to the extent of private respondent

No.5.

2. The case setup in the present writ petition is that the respondent

No. 4 has issued an Advertisement Notice for engagement of

AAYA’s in different schools of Zone Chamkote Kanah

including UPS Wanjil Sudpora, Karnah which was responded to

by the petitioner along with other candidates and the said

respondent No. 4 issued the tentative selection list of the

candidates for UPS Wanjil Sudpora, Karnah where under the

WP (C) No. 69 Page 1 of 3
petitioner figures at Sr. No. 2 and the private respondent No. 5 at

Sr. No.1.

3. It is submitted by the petitioner that the private respondent No. 5

does not belong to the concerned Panchayat Ward and, as such,

her selection in the tentative selection list is against the norms of

the relevant scheme. It is also averred that the petitioner has

approached the concerned authority and has also filed her

objections to the tentative selection list but despite elapse of one

year, objections have not been considered by the respondents

which prompted the petitioner to approach this Court through the

medium of instant writ petition for redressal of her grievances.

4. Heard learned counsel for the petitioner and have gone through

the material placed on record.

5. Learned counsel for the petitioner submits that the process for

engagement of AAYA’s for the UPS Wanjil Sudpora, Karnah is

yet to be finalized and is still going on.

6. In view of the nature of controversy involved in the present writ

petition, this Court is of the opinion that the instant petition can

be disposed of at its threshold stage by passing such orders which

will not prejudice the rights of any entitled person/party.

7. Accordingly, the writ petition is disposed of with a direction to

the respondents to consider the objections of the petitioner as

regards the tentative selection list dated 29.01.2024 to the extent

of private respondent No.5 for UPS Wanjil Sudpora, Karnah

within a period of seven working days from the date of receipt of

WP (C) No. 69 Page 2 of 3
certified copy of this order, provided the selection process has not

already been finalized.

8. It is also provided that while considering the objections of the

petitioner, respondents shall provide an opportunity of being

heard to the petitioner as also the respondent No.5 to put-forth

their respective stand(s) in support of their contentions.

9. Disposed of along with connected CM(S)
