Applicant was in judicial custody in
FIR/Crime No.545 of 2023, under
Sections 302, 504 and 506 IPC and 3/25
of the Arms Act, 1959, Police Station
Rudrapur, District Udham Singh Nagar.
The applicant was granted short term bail
on 12.12.2024 on the ground of his health
condition.
Now, a Time Extension Application,
IA No.07 of 2025, has been filed.
Learned counsel for the informant
would submit that the applicant is not
unwell; he was diagnosed with Spondylitis
at AIIMS, Rishikesh and the witnesses are
being threatened because the parties are
close relatives.
If the witnesses are being
threatened, the witnesses may approach
under the Witness Protection Scheme, so
that necessary steps may be taken. The
matter is being reconsidered on health
grounds. Certain documents have been
filed.
What was told before the Court
initially was that the applicant is 70 years
of age; he is unwell; he finds difficulty in
swallowing food; he is a patient of
Hepatitis-C.
Learned counsel for the applicant
now submits that the applicant should be
admitted in the hospital.
Having considered, without adverting
to the merits, purely on humanitarian
ground, the Court is of the view that the
Time Extension Application deserves to be
allowed.
The Time Extension Application is
allowed.
The short term bail of the applicant
is further extended to the period of four
weeks from the date of its expiry. It is
further directed that on expiry of the
duration of extended short term bail, the
applicant shall surrender before the court
concerned and a certificate be produced
before this Court.
