Heard learned counsel appearing on behalf of the

petitioner and learned Additional Public Prosecutor appearing

on behalf of the State.

2. The accused/petitioner is named in F.I.R. and

apprehending his arrest in connection with Kiul P.S. Case No.

68 of 2022, registered for the offences punishable under

Sections 147, 148, 149, 353, 436, 457, 380, 411, 302, 427

of the Indian Penal Code and Sections

150,151,152,145,146,147,174(A) of Railway Act.

3. As per the case of prosecution, more than 500

protesters including this petitioner pelted stones on train

coach and burned the train coaches by protesting the
Patna High Court CR. MISC. No.70201 of 2024(2) dt.18-01-2025

“Agnipath Scheme” related with new recruitment policy of

Indian Army.

4. Learned counsel appearing on behalf of the

petitioner submitted that the petitioner falsely implicated with

present occurrence purely on the basis of suspicion. It is

submitted that there is no specific allegation qua any overt act

against the petitioner, where the allegation appears prima

facie very much general and omnibus being part of crowd. It

is also pointed out that similarly situated co-accused persons,

namely Golu Kumar and Mulayam Singh Yadav granted

anticipatory bail by learned co-ordinate Benches of this Court

through Cr. Misc. No. 62195 of 2023 dated 19.02.2024 and

Cr. Misc. No. 84489 of 2023 dated 18.01.2024 respectively.

It is submitted by learned counsel that before this case, the

petitioner was of clean antecedent, whereas it is submitted

that regarding same occurrence one another case i.e. R.P.F.

Kiul-3/2022 was also lodged against this petitioner, where he

is on bail.

5. Learned APP opposes the prayer of bail.

6. Considering the aforesaid facts and

circumstances and by taking note of fact as the allegation

prima facie appears very much general and omnibus against

this petitioner being part of crowd, where several similarly

situated co-accused persons granted anticipatory bail by

different co-ordinate Benches of this Court, accordingly,

above named petitioner, in the event of his arrest or

surrender before the learned trial Court, within a period of

four weeks of the order, are directed to be released on bail

furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand)

with two sureties of the like amount each to the satisfaction of

the learned Railway Judicial Magistrate, Kiul,

Lakhisarai/concerned Court, where the case is pending in

connection with Kiul P.S. Case No. 68 of 2022, subject to the

conditions as laid down under Section 438(2)of the

Cr.P.C./482(2) of BNSS.
