Heard Mr. Z. Hammad, learned counsel for the accused and also heard Mr. K.K.
Page No.# 2/2

Parasar, learned Additional Public Prosecutor, Assam, appearing for the State respondent
No.1.

This application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita
(BNSS), 2023, is preferred by the accused, namely, Ferdaus Rahman, who has been
languishing in jail hazot since 29.10.2024, in connection with Bhelowguri P.S. Case
No.32/2023 under Section 498(A)/34 IPC, added Section 376/370 IPC, read with Section
6/17 of the POCSO Act and Section 9/10/11 of the Prevention of Child Marriage Act,
pending before the learned Special Judge (POCSO), Morigaon, for grant of bail.

Since the case has been registered under the POCSO Act, let notice be issued to
the respondent No.2 through the Registry of this Court, returnable on 04.02.2025.

In the meantime, the learned Additional P.P. shall produce the case diary before this
on the next date.
