Heard learned counsel for the parties.

2. The instant bail application has been preferred by the petitioner
for grant of regular bail in connection with Kunda PS Case No. 23 of 2023
for the offence registered under Sections 15/18/20/22/25(a)/27(a)/29/30 of
the Narcotic Drugs and Psychotropic Substances Act in NDPS Case No. 10
of 2024.

3. Pursuant to the earlier order passed in B.A No. 9723 of 2024
status report has been received indicating therein that though the charge has
been framed on 29.04.2024, however till date out of nine charge-sheeted
witnesses only two have been examined.

4. Learned counsel for the petitioner submits that there is no
likelihood of early conclusion of trial and the two witnesses who have been
examined have not supported the case of the prosecution. He lastly submits
that the co-accused, namely, Bhola Yadav has already been granted bail in
this case and the petitioner is in custody since 21.03.2023. As such, learned
counsel for the petitioner submits that the petitioner may be enlarged on bail.

5. Learned APP opposed the prayer for bail.

6. Having regard to the facts of the case that out of nine charge-
sheeted witnesses only two have been examined coupled with the fact that
those two witnesses have not supported the prosecution case, I am inclined

to enlarge the petitioner, above-named, on bail on furnishing bail bond of
Rs.10,000/- (Ten Thousand Only) with two sureties of the like amount each
to the satisfaction of the learned Additional Sessions Judge-IV cum Special
Judge NDPS Cases at Chatra in connection with Kunda PS Case No. 23 of
2023 corresponding to NDPS Case No. 10 of 2024.

7. It is made clear that during trial the petitioner shall appear on
each and every date before the trial Court and he shall not threaten any
witnesses and shall co-operate in trial. Further the petitioner will submit
photocopy of his Aadhar Card and mobile number before the trial Court
which he will always keep active and will not change.
