for the appellant.

Advocate assisted by Mr. Prabhat Kandpal, Brief

3. Present appeal is filed against the judgment
and order dated 30.03.2024, passed in Special
Sessions Trial No.18 of 2019 (Case Crime
No.530 of 2018), State Vs. Sanjeev Kumar and
another, punishable under Section 376 (AB) IPC
and Section 5(l)/6 of the Protection of Children
from Sexual Offences Act, 2012, Police Station
Pathri, Directed Haridwar, pending in the court
of Additional District Judge/FTSC, District
Haridwar.

4. Heard on Interim Bail Application, IA No.6
of 2025.

5. Learned counsel for the appellant/convict
would submit that the appellant/convict is a
sports person proficient in wrestling and he has
brought many awards and medals in this game
that the appellant/convict wants to participate in
the 38th National Games, which are proposed to
start on 28.01.2025 in Uttarakhand.

6. Learned State Counsel would vehemently
oppose the interim bail application on the ground
that on the directions of the Court, the
instructions were sought and Sub Inspector
Shahida Parveen, Thana Pathri, District
Haridwar, has stated in writing that when
enquired from the appellant/convict, he stated
that he did not give any application to participate
in the 38th National Games.

7. On enquiry, the learned counsel for the
applicant/convict would express ignorance to the
fact that whether some invite was sent to the
appellant/convict to participate in the 38th
National Game by the Wrestling Association of
Uttarakhand or was any application made
through proper channel, i.e. the Superintendant of
Jail, where the appellant/convict is lodged.

8. In view of the above, this Court does not
see any ground for allowing this interim bail
application. Hence, the interim bail application is
dismissed.

9. List this matter for hearing on 22.04.2025.
