CORAM:

HON’BLE MR JUSTICE RAJESH SEKHRI, JUDGE.

(ORDER)
23.01.2025
Petitioner has invoked the supervisory jurisdiction of this
Court in terms of Article 227 of the Constitution of India for the issuance of
an innocuous command to the Court of learned Judicial Magistrate 1st Class,
Shopian (for short “the Trial Court”) to decide the Complaint preferred by
him under Section 138 of the Negotiable Instruments Act, 1881 and 420
RPC within a reasonable time frame.

The short grievance of the Petitioner is that he preferred the
aforesaid Complaint in the year 2019 and the Trial Court has proceeded at a
snail’s pace, inasmuch as, till date, only two witnesses of the Complainant/
Petitioner herein have been recorded by the Trial Court.

Having regard to the limited nature of controversy involved in
the matter, the present Petition is admitted to hearing and is disposed of at
the threshold with a direction to the Trial Court to conclude the trial
expeditiously, preferably within a period of six months from the date a copy
of this Order is made available to it.

Petition is, accordingly, disposed of, along with the connected
CM.
