In this petition, petitioner seeks for quashing of the entire

proceedings in C.C.No.64/2022 on the file of II Addl. Civil Judge

(Jr.Dn) & JMFC, Udupi for the offences punishable under Sections

3(1), 4(1), 5(1) (A,B,D), 6(1)(A,B) and 7(1) (b) of Immoral Traffic

Act, 1956.

2. Heard learned counsel for the petitioner and learned

Additional SPP and perused the material on record.

3. A perusal of the material on record will indicate that

petitioner/accused No.5 and 4 others have been charge sheeted in

C.C.No.64/2022 for the offences punishable under Section 3(1),

4(1), 5(1) (A,B,D), 6(1)(A,B) and 7(1) (b) of Immoral Traffic Act,

1956.

4. It is the specific contention of the petitioner that even

according to the complaint, charge sheet and other material on

record, petitioner is only a customer and consequently, it cannot be

said that he is guilty of the offences alleged against him as held by

NC: 2025:KHC:2011

this Court in the case of Barath S.P. Vs. State of Karnataka &

Anr.,1 wherein it is held as under:
