Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to issue a writ, order or direction more in the nature of Writ of

Mandamus by declaring the action of the 3rd respondent in not relieving the
petitioner from the post of Associate Professor in the Dept, of Soil Science
and Agricultural Chemistry, Agricultural College of Pulivendula so as to join
the petitioner as General Manager in A.P. State Economically Backward
Classes, Welfare and Development Corporation as per the orders issued in
GO.Rt.No.7 Department of Economically weaker Section Welfare Dated
09.01.2025 on the file of the respondent as illegal, arbitrary, unjust and
against the Article 14, 16 and 21 of the Constitution of India and
consequently direct the 3rd respondent to relieve the petitioner from the post
of Associate Professor and the 2nd respondent may permit the petitioner to
join as General Manager in A.P. State Economically Backward Classes,
Welfare and Development Corporation and to pass

Petition under Section 151 CPC praying that in the circumstances stated
in the affidavit filed in support of the petition, the High Court may be pleased
direct the 3rd respondent to relieve the petitioner from the post of Associate
Professor and the 2nd respondent may permit the petitioner to join as
General Manager in A.P. State Economically Backward Classes, Welfare &
Development Corporation in compliance to the 1st respondent orders issued
in GO.Rt.No.7 Department of Economically weaker Section Welfare Dated;

The Court made the following ORDER:

Heard Sri Harinath Reddy Somagutta, learned counsel for the petitioner
and Sri M.Rahul Chowdary, learned counsel representing Smt.S.Pranathi,
learned standing counsel appeared on behalf of the 3rd respondent.

2. The petitioner, an Associate Professor, Department of Soil Science &
Agricultural Chemistry, Agricultural College, Pulivendula filed the above writ
petition to declare the action of the 3rd respondent in not relieving him from the
post of Associate Professor, in pursuance of G.O.Rt.No.7 Department of
Economically weaker Section Welfare, dated 09.01.2025 issued by the 1st
respondent, as illegal and arbitrary.

3. Learned counsel for the petitioner would submit that, in pursuance of
the recommendation of the 3rd respondent vide Lr.No.8074/Ser.II/A1/2024,
dated 15.11.2024 (Ex.P.2), the 1st respondent appointed the petitioner as
General Manager in A.P.State Economically Backward Classes Welfare &
Development Corporation on deputation under Foreign Service Rules vide
G.O.Rt.No.7 Department of Economically Weaker Sections Welfare, dated
09.01.2025 (Ex.P.3). Thereafter, the petitioner requested the 3rd respondent
by letter dated 09.01.2025 (Ex.P.4) to relieve him as Associate Professor,
Department of Soil Science and Agricultural Chemistry, Agricultural College,
Pulivendula. However, no order was passed and hence the writ petition was
filed.

4. Learned standing counsel on instructions of the Registrar, Acharya
N.G.Ranga Agricultural University would submit that the file relating to
relieving the petitioner from the duties of Associate Professor, Department of
Soil Science and Agricultural Chemistry, Agricultural College, Pulivendula is
under process and necessary orders will be passed within a week from today.

5. Given the instructions of the learned standing counsel, without going
into the merits of the matter, the Writ Petition is disposed of at the admission
stage with the consent of learned counsel on either side directing the learned
respondents to issue appropriate orders relieving the petitioner from the duties
of Associate Professor, Department of Soil Science and Agricultural

Chemistry, Agricultural College, Pulivendula within a week from today. No
order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
