1. Through the medium of the instant application, the petitioners seek the
permission of this Court for filing the instant writ petition in the
representative capacity on behalf of the inhabitants of Shah-I-Hamdan
Colony Village Hajin District Bandipora on the main ground that the
petitioners and the inhabitants of the Shah-I-Hamdan Colony have the
same interest in the subject matter of the petition and it is practically
impossible to array each and every resident of the Shah-I-Hamdan
Colony as the petitioner in the case. The application is supported with
an affidavit. Perused the application and heard the submissions of the
learned counsel for the petitioners.
2. This Court is of the opinion that it would be in the ends of justice in
case the provisional permission is granted, subject to objections for
filing the instant petition in the representative capacity. Accordingly
granted.
3. Accordingly, a publication regarding filing of the instant petition in
the representative capacity is directed to be made in two daily and
reputed Newspapers having wide circulation in the Kashmir Division
of the UT of J&K for general public information and filing of
objections, if any, regarding the instant petition being filed in the
representative capacity.
4. List along with the main petition on due date.

1 Issue notices to the respondents in the main petition as well as in the
interim application for filing of reply/objections returnable within a
period of four weeks, subject to taking of steps within a week’s
period.
1. Heard the learned counsel for the petitioner in respect of his prayer for
grant of interim relief and considered his submissions. Also perused
the main petition and copies of documents enclosed with the same, as
annexures thereto.
2. List on 17.03.2025.
3. In the meantime, subject to any vacation or modification, upon the
consideration of objections/arguments and till next date of hearing
before the Bench, the respondents are restrained from interfering with
the subject matter of the petition except in accordance with law.
