Heard Mr. Ch. Victor, learned counsel for the petitioner and
Mr. Y. Ashang, learned PP assisted by Mr. Phungyo Zingkhai, learned Dy.
Government Advocate for the respondent.
By the present petition, the petitioner approaches this Court for
releasing his husband, who is in custody in connection with FIR No.
146(12)2024 u/s 140(2)/127(1)/3(5) BNS, 16/17/20 UA(P) Act & 25 (1-A)
Arms Act, on interim bail for a period of 60-90 days as the petitioner is in the
final stage of pregnancy and there is no one to take care of the petitioner.
Mr. Y. Ashang, learned PP, submits that the prayer made by the
husband of the petitioner has already been duly considered and rejected by
the Trial Court and since the husband of the petitioner being involved in
heinous offence, it may not be proper to release him on interim bail.
Mr. Ch. Victor, learned counsel for the petitioner, submits that the
expected date of delivery of the petitioner is 09-02-2025 and without going
into the merit of the case and taking into consideration of the urgent need
for assistance to the petitioner as shown by the medical documents of the
petitioner, the husband of the petitioner may be released on interim bail.

In the circumstances, the accused/petitioner’s husband, namely
Tensubam Bangkim Singh @ Punshiba is released on interim bail for a
period of 45 days in connection with FIR No. 146(12)2024 u/s
140(2)/127(1)/3(5) BNS, 16/17/20 UA(P) Act & 25 (1-A) Arms Act to the
satisfaction of the learned Special Judge (NIA), Imphal West with the
following conditions:–
i) The accused shall execute a personal bond of Rs. 1,00,000/-
(Rupees one lakh) with surety (Government Employee) of the like
amount;
ii) The accused shall not leave station without informing the Sub-
Divisional Police Officer (SDPO), Imphal;
iii) The accused shall not indulge with persons acquainted with the
facts and circumstances of the present case; and
iv) The accused shall co-operate with the investigation appearing
before the SDPO, Imphal on every Sunday between 10.00 a.m. to
12.00 noon.
On the expiry of 45 days, the petitioner’s husband shall surrender
before the Superintendent of Manipur Central Jail, Sajiwa.
The Superintendent of Manipur Central Jail, Sajiwa shall forward a
copy of the proof of surrender to the SDPO, Imphal as well as to the learned
Special Judge (NIA), Imphal West for information.
With this observation, the bail application is disposed of.
Furnish a copy of this order to the learned Special Judge (NIA),
Imphal West for information and necessary order. Also furnish copy of this
order to the learned counsel appearing on behalf of the parties.
