1. Heard Mr. P.T. Sangma, learned counsel for the petitioner, who

has submitted that an FIR was lodged by one S.I. Patrick S. Sangma, Incharge

Rari OGC before the Officer-in-Charge, Bajengdoba Police Station on

24.11.2024. The allegations made therein pertains to seizure of alleged

psychotropic substances from one of the vehicle involved in an accident on

the same day i.e. 24.11.2024 at Snalgre, NH 51. On the said suspicious

psychotropic substances being seized, three accused persons were arrested in

connection thereof.

2. It is also the submission of the learned counsel that, in course of

investigation, the driver of the relevant vehicle had implicated the petitioner

herein, who incidentally was one of the passengers of the said vehicle on the

day the incident took place. He also submits that the petitioner is just a

passenger of the said vehicle, and has no knowledge or connection with the

said seizure made. In this regard, an application for grant of anticipatory bail

was preferred before the Court of the learned Special Judge (NDPS), North

Garo Hills District, Mendipathar, which eventually was rejected. Hence, this

petition.

3. The learned counsel has reiterated that the petitioner being

innocent, and is not at all connected with whatever has transpired on the said

date i.e. 24.11.2024, as such, anticipatory bail may be granted to him with any

conditions that this Court may deem fit and proper to impose.

4. Per contra, Mr. N. Syngkon, learned GA on behalf of the State

respondents, has opposed the prayer made on the ground that investigation is

ongoing, and it is reliably learnt that the involvement of the petitioner as far

as the seizure of the said contraband substances has been confirmed. However,

the learned GA has submitted that the report of the Investigating Officer as

well as copy of the case diary may be allowed to be produced in this regard.

5. On consideration of the submission made, the prosecution is

directed to produce the latest status report as well as copy of the case diary on

the next date fixed.

6. In the meantime, as prayed for, the petitioner is allowed to go on

interim bail on conditions that he shall not abscond, and that he shall cooperate

with the Investigating Officer as and when required.

7. List this matter on 13.02.2025.
