1. This case is registered U/sec. 200 of Cr.P.C

based on the written complaint given by the

complainant against the accused for the offence

punishable under Section 138 of Negotiable

Instrument Act, 1881 (hereinafter called as NI Act

for the purpose of brevity).

02. The case of the complainant in brief is as

follows:-

It is the case of the complainant that at the

request of the accused he has given hand loan of

Rs.3,00,000/- to the accused to meet his personal

commitments. Though the accused has agreed to

repay the same within 3 months but failed to do

so. The accused has only paid a sum of

Rs. 15,000/- each on 05.04.2019 and 09.05.2019

by way of two cheques. For the payment of the

balance amount of Rs.2,70,000/- he had issued a

cheque bearing No.436254 dated 14.08.2019,

drawn at Karnataka Bank, Hunsamaranahalli

branch, Bengaluru. When the said cheque is

presented for encashment through his Banker at

Corporation Bank, Yelahanka Branch, Bengaluru,

it is dishonoured on 16.08.2019 with an

endorsement as “Funds Insufficient”. As such the

complainant has issued demand notice dt:
