The present Applicat ion has been filed for

regular bail in connect ion wit h t he First I nform at ion

Report No. 5 of 2025, regist ered at police st at ion

Bhagwanpur, Dist rict Haridwar.

2. The applicant is in j udicial cust ody for t he

offence under Sect ion 3/ 5/ 11 of t he Ut t arakhand

Prot ect ion of Cow Progeny Act , 2007.

3. As per t he First I nform at ion Report , on a

secret inform at ion, t he police part y raided t he spot on

02.01.2025 and 100 Kg. of beef, cut t ing equipm ent s

et c. were recovered from t he spot . The applicant was

arrest ed by t he police part y. 1985

4. Heard Mr. Raj veer Singh, learned counsel for

t he applicant and Mr. Akshay Lat wal, learned Brief

Holder for t he St at e.

5. Mr. Raj veer Singh, learned counsel for t he

applicant , has cont ended t hat t he applicant has been

falsely im plicat ed in t he present m at t er. He was not

present at t he spot . Not hing was recovered from his

possession. He does not have any crim inal

ant ecedent s. He is a perm anent resident of Dist rict

Haridwar, t herefore, t here is no chance of his

absconding.

6. Mr. Akshay Lat wal, learned Brief Holder, has

opposed t he bail applicat ion orally.

7. Having considered t he subm issions of learned

counsel for bot h t he part ies and in t he fact s and

circum st ances of t he case, wit hout expressing any

opinion as t o t he m erit of t he case, t his Court is of t he

view t hat t he applicant deserves bail at t his st age.
