Mr. Lalit Sharma, learned counsel for the
applicant.

2. Mr. S.C. Dumka, learned AGA with Ms.
Sweta B. Dobhal, learned Brief Holder for the
State.

3. Heard.

4. Applicant is before this Court seeking
anticipatory bail in connection with FIR No. 32
of 2017, dated 10.03.2017, which was
registered at P.S. Pant Nagar, District Udham
Singh Nagar, for the offences punishable u/s
420
, 465, 467, 468, 471, 474, 120-B/34 IPC
and Sections 8/9 of the Prevention of
Corruption Act (Sessions Trial No.6 of 2019,
State vs. Ramesh Kumar and others, pending
before the Court of Special Judge, P.C. Act,
Nainital).

5. It is the contention of learned counsel
for the applicant that the said case was lodged
against as many as 113 accused persons in
respect of same land scam, which is commonly
known as ‘N.H. Ghotala in Uttarakhand’. It is
further submitted by him that most of the
accused persons have been enlarged on bail
by this Court, and many of them have been
given anticipatory bail by this Court. He
further submitted that this is a case of parity.

6. Per contra, learned State counsel does
not dispute this fact of the case being of parity
with those who have already been released on
bail or anticipatory bail. Some orders passed
by this Court are also annexed by the
applicant as Annexure No.4 in the paper book
of this anticipatory bail application.

7. In the facts and circumstances of the
case, the applicant- Lakhwinder Singh is
directed to be released on Anticipatory Bail, in
the event of his arrest, on his executing a
personal bond of Rs.30,000/- and furnishing
two reliable sureties, each in the like amount,
to the satisfaction of the SHO concerned, on
the following conditions:-

(i) Applicant shall attend the court
proceedings regularly and will not seek any
unnecessary adjournment;

(ii) Applicant shall not directly or
indirectly make any inducement, threat or
promise to any person acquainted with the
facts of this case.

(iii) Applicant shall not leave the country
without the previous permission of this Court.

8. The anticipatory bail application stands
allowed accordingly.
