1. Mr. A. K. Beniwal, learned counsel for the
applicants, through V.C.

2. Mr. Pratiroop Pandey, learned AGA for the State.

3. The present applicants ‘Shameem and Mahraj are
praying for anticipatory bail in relation to First
Information Report dated 15.02.2022 bearing FIR No.
0113 of 2022 P.S. Kaliyar Sharif, District Haridwar,
wherein the present applicants along with three
persons have been implicated for the offences
punishable under Section 323, 504, 313 and 498-A of the
IPC, 1860 read with Sections 3/4 of the Dowry
Prohibition Act, 1961.

4. It is contended by the learned counsel for the
applicants that the FIR has been registered pursuant to
an order passed by ACJM, Roorkee on 04.01.2022 on an
application moved under Section 156(3) of Cr.P.C.

5. He further submits that the allegation, as alleged
are purely matrimonial dispute and the applicant No.2
has nothing to do with this, since the applicant No.2 is
the sister-in-law (Nanad) of the victim, and,
furthermore, there are possibility of resolving the
matrimonial dispute.

6. Mr. Pratiroop Pandey, learned AGA for the State,
accepts notice on behalf of the respondent.

7. Let the counter-affidavit be filed by the State
within four weeks.

8. Two weeks’ time, thereafter, is also granted to the
counsel for the applicants to file rejoinder-affidavit.

9. List this matter on 29.08.2025.

10. In the meantime, the investigation may go on,
however, for an interim measure, it is directed that in
the event of arrest of the applicants, “Shameem and
Mahraj”, they shall be released on interim bail on
executing a personal bond and two reliable sureties
each of the like amount by each of them to the
satisfaction of the Investigating Officer/Arresting
Officer, subject to the following conditions:

(i) Applicants shall cooperate with the Investigating
Agency and they shall make himself available for
interrogation by a Investigating Officer as and
when required;

(ii) Applicants shall not directly or indirectly make
any inducement, threat or promise to any person
acquainted with the facts of this case.

(iii) Applicants shall not leave the country without
previous permission of this Court.
