2. Mr. B.C. Joshi, learned Assistant Government
Advocate for the State.
3. Applicants – Arvind Rawat, Ashok Rawat and
Bhanu Pratap Singh Rawat are seeking anticipatory
bail in F.I.R. No.05 of 2025, under Sections 120-B,
420, 467, 468, 471 IPC, Police Station Mussoorie,
Dehradun.
4. Learned State counsel vehemently opposed
the anticipatory bail application and would argue
that an equally efficacious remedy is available to the
applicants/accused to file the anticipatory bail
application before the Sessions Court but without
exhausting the same, the applicants/accused have
straightaway approached this Court.
5. To this, learned counsel for the
applicants/accused seeks permission to withdraw the
anticipatory bail application with liberty to take
appropriate legal remedy from the appropriate
Sessions Court.
6. Accordingly, the anticipatory bail application
is dismissed as withdrawn with liberty to the
applicants/accused to approach the court of sessions
seeking anticipatory bail.
