The petitioners have challenged the challan arising out of FIR No.
18/2022 for offence under Sections 341, 427, 336 of IPC registered with
Police Station, Lalpora, Kupwara which is stated to be pending before
the court of Judicial Magistrate 1st Class, Sogam, Kupwara. It has been
contended by the learned counsel for the petitioners that during the
pendency of the challan, the petitioners have entered into compromise
with respondent No. 2/the complainant but because offence under
Section 336 IPC is not compoundable, as such, the petitioners have
moved the present petition seeking quashment of the criminal
proceeding pending before the trial court.

Mr. Mubashir Majid, learned Dy. AG enters appearance and accepts
notice on behalf of respondent No. 1. Notice be sent to respondent No. 2
through concerned Police Station.
In the meantime, the proceedings pending before the learned trial
Magistrate shall remain stayed.
The petitioners and respondent No. 2 shall appear before this Court
on next date of hearing for recording their statement before the Registrar
Judicial of this Court.
