1. Heard learned counsel for the petitioners and

learned A.P.P. for the State.

2. Learned counsel for the petitioners, after arguing

vehemently for some time realising her difficulty, seeks

permission to withdraw the anticipatory bail application with

respect to petitioner No. 1, Achchelal Kumar @ Akshaylal Kumar.

3. Permission is accorded.

4. Accordingly, the anticipatory bail application is

dismissed as withdrawn with respect to petitioner No. 1

5. The petitioners apprehend their arrest in a case

registered for the offences punishable under Sections 341, 323,

325, 307, 504, 506 and 34 of the IPC.

6. Learned counsel for the petitioners submits that the

petitioner Nos. 2 to 5 are persons with clean antecedent and the

informant alleges that while on 28-6-2024, she was getting her

house constructed, when the accused persons came variously

armed and Akshaylal assaulted her husband, Surendra, by kudal

causing injury and when labourer, Sarwan, tried to save him,

when Akshaylal again assaulted him by dab causing injury on

his chin and thereafter accused persons dumped both the injured

in a septic tank.

7. Learned counsel for the petitioners submits that

petitioners have been falsely implicated in the instant case. It is

next submitted that on account of dispute relating to land, an

altercation took place, in which both sides assaulted each other.

It is further submitted that specific allegation of assaulting the

husband of the informant is against Akshaylal, who suffered

grievous injury and thereafter Akshaylal also assaulted Sarwan.

It is also submitted that petitioners are not criminals.

8. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.53614 of 2025(2) dt.20-08-2025

anticipatory bail of the petitioners.

9. Considering the submissions made by the learned

counsel for the petitioners, the petitioner No. 2 to 5 above-

named, in the event of their arrest or surrender before the

learned trial court within a period of six weeks from today, be

released on anticipatory bail on furnishing bail bonds of Rs.

10,000/- (Rupees Ten Thousand) each with two sureties of the

like amount each to the satisfaction of the learned trial court

where the case is pending/successor court in connection with

G.B. Nagar P.S. Case No. 339 of 2024, subject to the conditions

as laid down under Section 482 (2) of the BNSS.
