1. Taking into consideration that the dispute
between the parties is matrimonial in nature, the
matter was referred for mediation. Pursuant to the
efforts of the learned Mediator, a settlement has been
arrived at on 19.05.2025. The Settlement Agreement has
also been placed on the record.
2. A joint request has been made by the learned
counsel for the parties seeking that this Court invoke
its jurisdiction under Article 142 of the Constitution
of India and pass a decree of divorce by mutual
consent and further to quash all the cases pending

3. The petitioner-wife is present in the Court
through video-conferencing.
4. It is stated in the Settlement Agreement that the
mediation has been successful and the parties have
decided to give an end to their relationship as
husband and wife, on the terms and conditions, which
are stipulated in the Settlement Agreement. The
Settlement Agreement dated 19.05.2025 is duly signed
by the petitioner-wife (Aditi Gupta) and respondent-
husband (Adarsh Chandrakar), and their respective
advocate as well as the learned Mediator.
5. As per the Settlement Agreement, the respondent-
husband has agreed to pay a total sum of Rs.
20,08,000/- to his children. Out of this amount, Rs.
10,00,000/- has already been paid to the petitioner-
wife on 01.06.2025 by way of cheques bearing Nos.
10017318 and 10017319.
6. It has also been agreed that the respondent-
husband shall pay an amount of Rs.6,000/- per month,
per child to the petitioner-wife in installments for a
period of seven years.

7. From the pleadings on record, it is clear that
the marriage between petitioner-wife and respondent-
husband has irretrievably broken down. We, therefore,
find that this is a fit case in which this Court
should invoke its jurisdiction under Article 142 of
the Constitution of India and give an end to the
relationship between the parties.
8. Therefore, the marriage between petitioner-wife
and respondent-husband is dissolved as per terms and
conditions stipulated in the Settlement Agreement.
9. In view of the above, the following cases pending
between the parties are quashed and set aside:
(i) Case no. 552 of 2020 titled as Smt. Aditi
Gupta and Ors. V. Adarsh Chandrakar & Ors.
pending in the court of Civil Judge (Junior
Division) Fast Track Court No. 01 at Agra
Filed under the Domestic Violence Act, 2005.
(ii) Criminal case No. 53568 of 2021, pending
in the court of the Chief Judicial Magistrate,
Agra arising out of the FIR no. 0388 of 2020,
lodged in New Agra Police Station, Agra on
04.07.2020 under section 498 A, 323, 504 and
506 of the Indian Penal Code.
(iii). Maintenance case, U/s 125 Cr.P.C. vide
Criminal Application no. 1920 of 2022 titled
as Smt. Aditi Gupta and 2 ors. V. Shri Adarsh

Chandrakar, pending before the Court of
Principal Judge, Family Court, Agra, (Uttar
Pradesh).
(iv) Civil Misc. Case no 128 of 2024, titled
as Smt. Aditi Gupta alias Aditi Chandrakar V.
Adarsh Chandrakar, pending before the
Principal Judge, Family Court, Raipur
(Chhattisgarh).
(v). Application U/S 482, Case No. 43183 of
2022, titled as Adarsh Chandrakar Versus State
of U.P. and Another, pending before the High
Court of Allahabad.
10. The Settlement Agreement is taken on record and
is to be treated as an undertaking given to this
Court.
11. The Registry is directed to draw a decree for
divorce accordingly.
12. The transfer petition is, accordingly, disposed
of.
13. We place on record our appreciation for the
sincere efforts put in by the learned Mediator- Gargi
Khanna and learned counsel for the parties for
successful completion of the mediation.

14. Pending application(s), if any, shall stand
disposed of.
