The Police Inspector of Adugodi Traffic Police
Station has filed charge sheet against the accused for the
offence punishable U/Sec.279, 337, 304(A) of IPC,
Sec.134(A & B) R/w Sec.187 and Sec.119 R/w Sec.177
of IMV Act.
2. The brief facts of the prosecution case are as
under: –
That on 10.12.2023 at 3.45 a.m. accused being the
driver of Tata Goods vehicle bearing registration No.KA-
52-B-6642 drove the same within the jurisdiction of
Adugodi Traffic Police station on Koramanagala
Sarjapura Main road from St. Johns hospital at a high
speed in a rash and negligent manner so as to endanger
human life and while jumping the water tank junction
signal hit to C.W.2’s motor cycle bearing registration
No.KA-03-KM-1479 which was proceeding from Ayyappa
Swamy temple towards BDA junction, as a result rider
C.W.1 and pillion rider Sri.Vinod Kumar fell down along
with the vehicle and rider sustained simple injuries and

pillion rider sustained grievous injuries on his head and
both legs and hands and while taking treatment at
Victoria hospital on the same day at 10.10 p.m. he
succumbed to death. Further, after the accident accused
has failed to provide medical assistance to the deceased
and also failed to inform the same to the nearest police
station. As such the accused has committed an offence
punishable U/Sec.279, 337, 304(A) of IPC, Sec.134(A &
B) R/w Sec.187 and Sec.119 R/w Sec.177 of IMV Act.
