(2 of 1974) , S.482— Constitution of India , Art.226— Quashing of FIR – Prayer for – Allegation that accused in connivance with co-accused defaulted in payment to complainant’s company to the tune of Rs. 9 Crores -.Complaint of committing default in payment was not made against accused or against the company in which he was the Project Manager, but was made against different companies – FIR did not disclose commission of offence(s) as alleged – Asking accused to stand trial would be abuse of process of law – Further proceedings based on such FIR would result in miscarriage of justice – FIR and consequential proceedings were quashed.
