Criminal P.C. (2 of 1974) , S.482— Quashing of FIR – Prima facie case – FIR was based on allegations made by complainant that appellant had sexually exploited her under a false promise of marriage – Complainant had previously filed a similar complaint against another individual for identical allegations – Inconsistencies were found between present FIR and another FIR lodged against appellant, especially omission to mention some incidents in earlier FIR which had allegedly taken place before earlier FIR was lodged- Complainant, a well-educated woman, had made contradictory statements – Chats revealed her manipulative and vindictive behaviour, suggesting she had ulterior motives – Even if appellant had backed out of marriage, it could not be considered sexual intercourse under a false promise of marriage, nor could it be linked to caste of complainant- Caste related allegations in subsequent FIR appeared to be exaggerated and unfounded – FIR was based on fabricated and malicious allegations – FIR and all related proceedings were quashed.
