Kerala Anti-Social Activities (Prevention) Act (34 of 2007) , S.3— Preventive detention – Legality of order for- A person who indulges in activities ‘harmful to maintenance of public order’ is sought to be covered by the Act of 2007 – Grounds cited by detaining authority did not establish any threat to public order, and no specific reasons were given to warrant preventive detention – Although detention order stated that detenue violated bail conditions, State had neither moved any application for cancellation of bail, nor had it specified what conditions were breached – Facts did not justify use of an extrAORdinary remedy – Detention order was set aside.
