CRL.M.(BAIL) 04/2025 (Extension of interim suspension of sentence)
1. This application has been filed seeking extension of interim suspension
of sentence granted by this Court vide order dated 02nd December 2024.
2. By the said order, in view of the medical condition of the appellant,
interim suspension of sentence of four weeks was granted.
3. Counsel for appellant has placed certain medical documents on record in
particular, one dated 01st January 2025 issued by Senior Consultant of
Dashmesh Hospital stating that the appellant has been advised admission in
General Ward for the purposes of treatment.
4. APP for State, however, objects to the same considering that, as per the
Nominal Roll, the appellant was sentenced to RI 23 years for offence under
Sections 376D IPC, RI 5 years and RI 3 years for offences under Section 506

read with Section 34 and Section 354 read with Section 34 IPC, respectively,
and has undergone only 3 years of sentence.
5. Counsel for appellant states that the appellant is admitted at Dashmesh
Hospital and the surgery is scheduled for today.
6. Taking the statement made by counsel for appellant on record and in
view of these particular facts and circumstances, the interim suspension of the
appellant as granted by the Court is extended for four (4) week for his surgery
and recovery.
7. The extension will be on the same terms and conditions as directed in the
order dated 02nd December 2024.
8. It is made clear that no further extension shall be granted, and the
appellant is expected to manage his medical condition in the time granted by
this Court.
9. Accordingly, application is disposed of.
