Learned counsel for the petitioner has submitted that the

petitioner was sanctioned maternity leave when she was rendering

services at Mahila Chikitsalya, Sanganeri Gate, Jaipur, which was

valid upto June, 2025. It is further submitted that petitioner

delivered a baby on 05.01.2025.

Further, it is submitted that thereafter petitioner was

appointed for the post of Assistant Professor at Nagaur, where

petitioner has applied for extension of maternity leave benefit

before the new employer. However, the said extension was not

granted to the petitioner. Therefore, being aggrieved of the same

the petitioner has filed the present petition.

Additionally, the petitioner has filed a representation before

the competent authority-Director, Rajasthan Medical Education

Society (Annexure-6), however the same is not considered.

Lastly, learned counsel has placed reliance upon the

judgment passed in DBSAW No. 376/2021 titled as State of

Rajasthan and Ors. vs. Smt. Neeraj.

Issue notices.

On directions of the Court, Mr. Archit Bohra, AGC accepts

notice on behalf of respondents.

A copy of the petition is also supplied by the petitioner to the

respondents Mr. Archit Bohra, AGC during the course of

arguments.

Learned counsel for the respondents has assured to

adjudicate the representation filed by the petitioner (Annexure-6),

looking to the facts and circumstances, strictly within a period of

seven days.

Considering the facts and circumstance of the case, and

considering the arguments put-forth by the learned counsel for

the parties, this Court directs the competent authority/Director to

adjudicate the representation filed by the petitioner (Annexure-6),

in accordance with law, strictly within a period of seven days from

the passing of this order. Howsoever, liberty is granted to the

petitioner to approach appropriate forum/Court, if still aggrieved.

Accordingly, the present petition is disposed of. Pending

applications, if any, shall stand disposed of.
