1. This anticipatory bail application under Section 482 of the
BNSS (438 of Cr.P.C.) has been filed by the petitioner
apprehending his arrest in connection with FIR No.69/2023,
registered at Police Station Dhamotar, District Pratapgarh for the
offences under Sections 420, 409, 467, 468 and 120-B of IPC.
2. Heard learned counsel for the petitioner and learned Public
Prosecutor. Perused the material available on record.
3. It is contended by learned counsel for the petitioner that the
petitioner is seeking anticipatory bail on the ground that the
allegations levelled against him are false and fabricated. It is
further submitted that the petitioner has no direct or indirect role
in the commission of the alleged offence.
4. In compliance with the directions issued by a Coordinate
Bench of this Court, the petitioner has already appeared before
the Investigating Officer, who has interrogated him and no

recovery is to be made from the petitioner. Learned counsel
further submitted that co-accused Arpit, Ajay @ Ajju and Sunil
have already been granted bail by a Coordinate Bench of this
Court vide order dated 14.08.2023 passed in S.B. CRLMB
Nos.10109/2023, 10111/2023 and 10112/2023.
5. It is also submitted that the petitioner has been granted
anticipatory bail by a Coordinate Bench of this Court vide order
dated 16.11.2023 passed in S.B. Criminal Misc. Bail Application
No.13475/2023 in a similar case arising out of another FIR.
6. Per contra, learned Public Prosecutor has vehemently opposed
the anticipatory bail application and submitted that although other
co-accused have been granted bail, the petitioner does not
deserve the same indulgence.
7. Having regard to the facts and circumstances and submissions
made, as the co-accused have been granted bail and no recovery
is attributable to the petitioner, who has already appeared before
the Investigating Officer, this Court finds it a fit case for grant of
anticipatory bail under Section 482 of BNSS (Section 438 Cr.P.C.).
8. Accordingly, the bail application is allowed and it is directed
that in the event of arrest of petitioner- Amul S/o Shri Motilal,
in connection with FIR No.69/2023, registered at Police Station
Dhamotar, District Pratapgarh, the petitioner shall be released on
bail; provided he furnishes a personal bond in the sum of
Rs.50,000/- each along with two sureties of Rs.25,000/- each to
the satisfaction of the concerned Investigating Officer/S.H.O. on
the following conditions :-

(i). that the petitioner shall make himself available for
interrogation by a police officer as and when required;
(ii). that the petitioner shall not directly or indirectly make
any inducement, threat or promise to any person
acquainted with the facts of the case so as to dissuade him
from disclosing such facts to the court or any police officer;
and
(iii). that the petitioner shall not leave India without
previous permission of the court.
