By way of filing the instant criminal misc. petitions under
Section 528 BNSS, the petitioners have prayed for quashing of the
FIR No.56/2024 lodged by the complainant Rameshwar Lal at
Police Station Nagori Gate, Jodhpur City East for the offences
under Sections 341, 323, 324, 307 and 143 IPC so also the FIR

No.57/2024 lodged by the complainant Anil at Police Station
Nagori Gate, Jodhpur City East for the offences under Sections
As per FIR No.56/2024, on 28.3.2024 the petitioners
abducted victim – Ritesh aged about 16 years and brutally beaten
him with blunt and sharp weapons. The petitioners – accused
persons also circulated a video on social media platforms in which
petitioners could be seen beating and threatening the victim.
Learned counsel for the petitioners and respondent No.2
jointly submitted that during pendency of the investigation in
relation to FIRs No.56/2024 and 57/2024 registered at Police
Station Nagori Gate, Jodhpur City East, the parties have entered
into a compromise and have decided to settle their dispute
amicably and therefore, the impugned FIR may be quashed and
set aside.
This Court looking to the nature of allegations levelled
against the petitioners vide order dated 10.7.2025 directed the
learned Public Prosecutor to call for the injury report of the victim
– Ritesh.
In compliance of this Court’s order dated 10.7.2025, learned
Public Prosecutor has placed on record the injury report of the
victim – Ritesh.
The injury report dated 18.4.2024 indicates that in the
alleged incident, the victim- Ritesh has been inflicted multiple
injuries out of which injury No.1 is life threatening.
In the opinion of this Court, the allegations levelled against
the petitioners are very serious and the power under Section 528
BNSS (Section 482 Cr.P.C.) cannot be used or acted upon to quash

the criminal proceedings launched in respect of heinous crime
against the society based on compromise. In the present case,
the victim is 16 years old boy and therefore, the offence cannot be
said to be private in nature or has no serious impact on the
society.
In view of the above, this Court does not find any force in
the instant criminal misc. petitions and the same are dismissed
being devoid of any merit.
Stay petitions also stand dismissed.
