The appellant is in judicial custody in Sessions Trial No.

25 of 2018, arising out of Case Crime No. 91 of 2018, under Sections

147/148/149/302/307/323/504/506 IPC and Section 3(2)(v),

3(1)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of

Atrocities) Act, 1989, P.S. Jhabrera, District Haridwar.

2. The appellant had sought bail, which was rejected by

order dated 22.03.2025, passed in 5th Bail Application 245 of 2025,

Anil v. State of Uttarakhand, by the court of Sessions Judge,

Haridwar, against which instant appeal has been preferred.

3. Heard learned counsel for the parties and perused the

record.

4. At the very outset, learned Senior Counsel for the

appellant submits that the appellant is in judicial custody since

11.05.2018; there are 22 prosecution witnesses, out of which only 13

witnesses have been examined; there are less chances of conclusion of

Sessions Trial in near future.

5. These facts are not disputed by the learned counsel for

the State as well as learned counsel for the informant.

6. Having considered, this Court is of the view that the

appellant deserves to be enlarged on bail and the appeal deserves to be

allowed.

7. The appeal is allowed. The order dated 22.03.2025

passed by the learned Sessions Judge, Haridwar in 5th Bail Application

No. 245 of 2025 is set aside.

8. Let the appellant be released on bail on his executing a

personal bond and furnishing two reliable sureties, each of the like

amount, to the satisfaction of the court concerned.
