Order No. 21.01.2025 01. 1. Heard.
2. The petitioner by invoking inherent jurisdiction
of this Court under Section 482 Cr.P.C. is seeking
direction to the learned CJM-cum-ASJ, Bhadrak for
early disposal of S.T. Case No.30/70 of 2023. The case is
emanating from an FIR registered on 19.02.2021. The
charge sheet in the present case has been filed on
17.04.2021 for the alleged commission of offence
punishable under Sections 452/294/323/427/342/

354/307/379/341/34 IPC. In the charge sheet ten
witnesses have been cited by the prosecution, out them
seven witnesses have already been examined. In so far
as remaining three witnesses are concerned, summons
has been repeatedly issued to the said witnesses.
However, they did not turn up for deposition, as a result
of which the trial is prolonged. At this stage, the
petitioner has filed this present petition seeking direction
as mentioned above.
3. Learned counsel for the petitioner submits that
the trial court should issue stringent process against the
remaining three witnesses so that the evidence of the
prosecution could be concluded as expeditiously as
possible.
4. The contention or Mr. Jena, learned counsel for
the petitioner deserves merit. Accordingly, the present
petition is allowed. The trial court is directed to see that
the remaining three witnesses of the prosecution are
examined as expeditiously as possible, for that the trial
court is at liberty to issue stringent process against the
said three witnesses. Needless to say that the petitioner
being an accused facing trial of serious offences has
constitutional and statutory right of free, fair and speedy
trial. Hence, the trial court shall also expected do well

to see that the trial of the case is concluded as
expeditiously as possible.
5. With this observation, the CRLMC is disposed
of.
