In the instant petition, petitioner has prayed for

the following relief(s):-

(i) For issuance of an
appropriate writ and/ or order and/ or direction
commanding the respondents i.e respondent no. 5
to issue Land Possession Certificate (L.P.C.) to the
petitioner so that the petitioner may get
compensation from the authority in lieu of
acquisition of land for Hathua Bhatni Bari Rail
Line Project in view of Award No. 51 in L.A. No.
69 and 70.

(ii) For any other relief

which may deem fit and proper in the facts and
circumstances of the case.

2. Learned counsel for the petitioner has

submitted that petitioner applied online application for land

possession certificate before the Circle Office, Phulwaria

(Annexure-P/3) but the Circle Officer, Phulwaria has not issued

land possession certificate in favour of the petitioner as yet.

3. Learned counsel for the State has submitted

that if petitioner files fresh application either through online

mode or physical mode before the Circle Officer, Phulwariya,

Gopalganj for issuance of land possession certificate, the

concerned Circle Officer shall look into the matter.

4. Considering the facts and circumstances of the

case and the submissions advanced on behalf of the parties, the

present writ petition stands disposed of with direction to

petitioner to file fresh representation either through online mode

or physical mode for issuance of land possession certificate

before respondent no. 5/ the Circle Officer, Phulwariya,

Gopalganj within a period of four weeks from the date of receipt

of this order. If petitioner raises his grievance before the

concerned Circle Officer by filing fresh representation within

the stipulated period, the concerned Circle Officer shall pass

appropriate order on the representation of the petitioner in

accordance with law after giving due opportunity of hearing to

the petitioner within a reasonable time.
