Heard learned counsel appearing on behalf of the
petitioners and learned A.P.P. appearing on behalf of the State.
2. At the outset, learned counsel for the petitioners
seeks permission to withdraw the anticipatory bail application
on behalf of Petitioner No. 3, namely Md. Samjani, as during
pendency of this case, Petitioner No. 3 has already been arrested
and the same has become infructuous.
3. Permission, as prayed for, is accorded.
4. Accordingly, this anticipatory bail application on
behalf of Petitioner No. 3 stands dismissed as withdrawn.
5. The Petitioner Nos. 1 and 2 apprehend their arrest
Patna High Court CR. MISC. No.19850 of 2025(2) dt.19-04-2025

in a case registered for the offence punishable under Sections
147, 148, 149, 120B, 186, 188, 341, 342, 323, 324, 325, 332,
333, 353, 307, 337, 354B, 504 and 506 of the Indian Penal
Code.
6. As per prosecution case, all the F.I.R. named
accused persons, including these petitioners, are alleged to have
abused and assaulted police personnel by means of lathi and
danda causing hindrance in discharge of their official duties.
7. Considering the nature of accusation, the prayer for
grant of anticipatory bail to Petitioner Nos. 1 and 2 is dismissed.
8. Accordingly, this application stands disposed of.
