1. Heard learned counsel for the applicant and learned A.G.A. for the State.
2. This is the second bail application of the applicant. The first bail application of the applicant was rejected by this Court on 04.07.2022.
3. By means of the present bail application, the applicant seeks bail in N.C.B. Crime No. 11 of 2020, under Sections 8, 18, 25, 29, 60(3) of Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as “NDPS Act”), Police Station- N.C.B., District- Lucknow, during the pendency of trial.
4. According to prosecution, the recovery is of 31 Kgs. Opium, while the commercial quantity is of 2.5 kg. The order passed on the earlier bail application is extracted hereas under:-
