Upon hearing the counsel the Court made
the following
O R D E R
1. The petitioner challenges the judgment
and order dated 04.12.2023 in Criminal
Miscellaneous No.68766 of 2023; and the
judgment and order dated 21.11.2024 in
Criminal Miscellaneous No.71141 of 2024,
titled “Arvind Kumar Yadav vs. The State
of Bihar”.
2. The petitioner was arrested in
connection with S.T. Case No.601 of 2023
arising out of Rudrapur Police Station
Case No.62 of 2023 for the offences
punishable under Sections 147, 148, 149,
S.L.P.(Crl.) Nos.6140-6141 of 2025 2
341, 323, 324, 307, 354(B), 379, 504 & 506
of the Indian Penal Code (For short, ‘the
IPC’). Subsequently, Section 302 of the
IPC and Section 27 of the Arms Act were
added.
3. The petitioner has been behind bars
since 06.06.2023. We notice that the
material witnesses already stand examined
and the trial is in progress, in which,
undisputedly, the petitioner is
cooperating, and all other co-accused have
also been enlarged on bail.
4. In this view of the matter, we are of
the considered view that the petitioner
has made out case for interference with
the impugned judgment and order dated
04.12.2023 & 21.11.2024.
5. The petitioner be released on bail on
such terms as may be fixed by the Trial
Court. Ordered accordingly.
6. To comply with the order, the
petitioner shall be produced before the
Trial Court forthwith.

7. Trial expedited. The petitioner shall
fully cooperate during the trial, and it
shall be open to the Trial Court to take
all steps, including cancellation of bail,
if so warranted.
8. Accordingly, the Special Leave
Petitions are disposed of.
9. Pending application(s), if any, shall
stand disposed of.
