1. The accused/applicant seeks interim bail in case FIR No. 354/2022 of
PS Hari Nagar for offence under Section 307/302/120B/34 IPC and 25/27
Arms Act.
2. In furtherance of last order, learned APP submits that she has received
Medical Status Report from jail and shall file the same during the course of
the day. The Status Report is accepted across the board, to be scanned and
made a part of the record. Copy already supplied.
3. According to the detailed Status Report, the accused/applicant is
suffering from the problem of fissure in anus and for that, he can be
appropriately treated at DDU Hospital, attached with the jail. Learned APP
submits that State shall ensure best possible medical treatment to the
accused/applicant but for that purpose, he be not granted interim bail in view
of the nature of allegations.

4. In view of above circumstances, learned counsel for accused/applicant
seeks passover to obtain instructions.

6. In this post-lunch session, having obtained instructions from his
client, learned counsel for accused/applicant seeks permission to withdraw
this application. The application is accordingly dismissed as withdrawn with
the directions to the jail authorities to initiate medical treatment of the
accused/applicant tomorrow itself. Further, as requested, if need be, the
accused/applicant shall have liberty to approach the Court of Sessions for
any further relief in accordance with law.
