Heard learned counsel for the petitioner and
learned counsel for the opposite parties.

This writ petition has been filed by the petitioner
Ashis Pradhan seeking for a direction to the opposite
parties nos.1 to 3 to supply the loan documents to the
petitioner within a time stipulated by this Court in
order to prefer application under section 17 of the
SARFAESI Act, 2002 before the Debts Recovery
Tribunal, Cuttack.

Learned counsel for the Bank of India submits
that in the meantime, the auction sale has already
been taken place, sale certificate has already been
issued and possession has also been handed over.
Since third party right has been created as held in the
case of CELIR LLP vs. Bafna Motors (Mumbai) (P)
Limited, reported in 2023 SCC OnLine SC 1209
interference by this Court at this stage is forbidden.
