Heard learned Senior Counsel for the appellant and

the State.

2. The present appeal has been preferred for:

quashing the order of cognizance
dated 16.02.2018 by which the court of Spl.
Judge SC/ST Act, Purnea has taken the
cognizance against Appellants in SC/ST P.s.
case no. 45 of 2016 for offences under
sections 448, 341, 323, 354, 379, 504,
506/34 of I.P.C. and 3(i)(r)(s)(w)(i) of SC/ST
(POA) Act.

3. Issue notice to the respondent no. 2 both on the

appeal as also the Interlocutory Application through both

processes i.e. ordinary as well as registered cover with A/D for

which requisites etc. must be filed within a period of two weeks

failing which the application shall stand rejected without further

reference to the Bench.

4. In case, the order passed is not complied and the

matter accordingly stands dismissed, subsequently, the same be

posted under the heading ‘To be Mentioned’.
