This is a private complaint filed under section 200 of
Cr.P.C., against the accused for the offence punishable under
section 138 of the Negotiable Instruments Act.
02.The brief facts of the complaint is as under:
The complainant and accused were former colleagues at
BSNL, Vijayanagar, Bengaluru. Out of said acquaintance,
accused has availed a hand loan of Rs 6,00,000/- in the year-
2020 from complainant to install bore-well in his agricultural
land and promised to return the same soon after his
retirement. But, the accused failed to repay the amount
within agreed time. After repeated several requests and
demands, to discharge said liability, accused has issued a
cheque bearing No 901323 dated 09-09-2021 for
Rs.6,00,000/- drawn on Vijaya Bank, Moodalapalya branch,
Bengaluru, in favour of the complainant. The complainant
presented said cheque for encashment through his banker
Corporation Bank, Mahalakshmi Layout Branch, Bengaluru.
