                         JUDGMENT

On 05.07.2019 B.G.Papaiah asserting to be guardian

of his wife Smt.B.S.Rajamma, filed petition under Section

166 of IMV Act claiming compensation worth of

Rs.5,00,00,000/- from the respondents, who are the

owner and insurer of the motorcycle bearing No.KA-43-L-

6993 alleging that on 28.01.2019 at about 9.30 a.m. when

Smt. Rajamma about to cross Kodigehalli road, near

Muthyalamma temple, Doddaballapura town to reach

Anagalapura village , rider of motorcycle bearing No.KA-43-

L-6993 rode the same negligently, dashed the same to

Rajamma, thereby caused the accident, caused grievous

injuries to Rajamma.

2. Immediately after the accident Rajamma has been

shifted to Govt. hospital , Doddaballapura, then to

Columbia Asia Clinic at Doddaballapura, wherein first aid

has been provided , then admitted to Columbia Asia

Hospital, Yeshwanthpura, Medstar hospital , Kodigehalli,

Bengaluru, Basavashri Diagnostic Center and Reneu Life

Physiotherapy and Rehabilitation, Unit of Siddaganga

Healthcare Center at Nagarabhavi, Bengaluru for

treatment.

3. In view of the injuries suffered in the accident,

inspite of better treatment on 23.09.2021 Smt. Rajamma

expired.

4. As on the date of accident Rajamma, being aged 44

years , used to earn Rs.45,000/p.m. by working as Asst.

Teacher at Government Lower Primary School,

Anagalapura village, Doddaballapura taluk, used to

contribute the entire income to the family.

5. Regarding accident Doddaballapura Town police

registered crime No.10/2019 .

6. In response to the notice, respondent No. 1 owner

of the motorcycle appeared through his Advocate, but

neither filed written statement nor participated in the

proceedings.

7. In response to the notice, respondent No. 2

insurance company appeared through his Advocate on

26.09.2019 filed written statement denying the allegation

regarding reason, mode of accident, nature and

consequence of the injuries suffered by Rajamma, age

occupation and income of Rajamma.

8. On the basis of the pleadings on 04.11.2019, this

Authority has framed the following issues:

1. Whether the petitioner proves that she
sustained grievous injuries in a Motor Vehicle
Accident that occurred on 28.01.2019 at about

9.30 a.m. near Muthyalamma temple,
Kodigehalli road, Doddaballapura town, within
the jurisdiction of Doddaballapura Town police
station on account of rash and negligent riding
of the motorcycle bearing registration No.KA-
43-L-6993 by its rider when the petitioner was
about to cross the road?

2. Whether the respondent No.2 proves that the
accident has occurred on account of negligent
act of petitioner herself ?

3. Whether the petitioner is entitled for
compensation ? If so, how much and from
whom?

9. By get appointing the Court Commissioner, through

Court Commissioner B.G.Papaiah , husband of Smt.Rajamma

get recorded the evidence of Dr.N.Shobha as PW1 , get marked

3 documents at Ex.P.1 to P.3 on 03.02.2021 about the health

status of Smt.Rajamma.

10. As noted above on 23.09.2021 Smt.Rajamma

expired. Then by filing application under Order XXII Rule 3 of

CPC B.G.Papaiah , P.Dhanushree, P.Srinivas, husband and

children of deceased Rajamma, get impleaded as petitioner

No.1(a) to 1(c).

11. On 10.08.2023 respondent No.2 insurance company

filed additional written statement.

12. After amendment of the petition and filing of the

additional written statement by respondent No,2/insurance

company , on 14.08.2023 , this authority has framed the

following additional issues:

1. Whether the petitioners prove that the
deceased Petitioner died on 23.09.2021 on
account of accidental injuries and there is
nexus between accidental injuries and her
death?

13. On 24.08.2023, 25.06.2024 B.G.Papaiah deposed as

PW2 and produced 34 documents at Ex.P.4 to 37. On

26.02.2024, 28.03.2024, 03.07.2024 B.G.Papaiah produced

the evidence of Medical Record Officer of Columbia Asia

Hospital (now Manipal hospital), Bengaluru, Medstar

Speciality hospital , Kodigehalli, Bengaluru as PW3 to 5 and

get produced 10 documents at Ex.P.38 to P.47.

14. I heard the arguments submitted on behalf of

petitioners No.1(a) to (c) and respondent No.2 perused the

records.

15. On the basis of material on record, my findings

on the above issues are as under:

REASONS

16. Issues No.1, 2 and additional issue :- In the

argument learned Advocate appearing for the respondent

No.2, by analyzing the evidence available in file, submitted

that there is no nexus between injuries and death of

Rajamma by relying on the following judgments:

17. In the lengthy argument, learned Advocate

appearing for petitioners No.1(a) to (cc), by analyzing the

evidence available on file, requested to award reasonable

compensation and to impose the liability on the second

respondent .

18. In the light of the submission made on behalf of

both the parties with reference to the judgments cited

above, I have appreciated the materials on file.

19. In the evidence affidavit PW2 B.G.Papaiah ,

husband of deceased Rajamma stated that on 28.01.2019

at about 9.30 a.m. when Rajamma about to cross

Kodigehalli road, near Muthyalamma temple,

Doddaballapura town to reach Anagalapura village , rider

of motorcycle bearing No.KA-43-L-6993 rode the same

negligently, dashed the same to Rajamma, thereby caused

the accident, caused grievous injuries to Rajamma.

20. After accident Rajamma who has been shifted to

Govt. hospital , Doddaballapura, wherein first aid has been

provided , then shifted to Columbia Asia Clinic at

Doddaballapura, wherein further treatment has been

provided , then get treated Rajamma at Columbia Asia

Hospital, Yeshwanthpura, Medstar hospital , Kodigehalli,

Basavashri Diagnostic Center and Reneu Life

Physiotherapy and Rehabilitation, Unit of Siddaganga

Healthcare Center at Nagarabhavi, Bengaluru , Sri

Dharmasthala Manjunatheshwara Institute of Ayurveda

and hospital , Kumbalagodu , Bengaluru from 28.01.2019

to 15.02.2019, 15.02.2019 to 23.02.2019, 23.02.2019 to

04.09.2019, 24.01.2021 to 07.02.2021.

21. PW2 stated that in view of the injuries suffered in

the accident, inspite of better treatment, on 23.09.2021

Smt.B.S.Rajamma expired.

22. In the written statement and additional statement,

respondent No.2 insurance company denied the allegation

regarding reason, mode of accident, nature and

consequence of the injuries suffered by Rajamma and

reason for death of Rajamma.

23. In the cross-examination, PW2 B.G.Papaiah stated

he never witnessed the accident, after 3 days of the

accident, elder brother of Rajamma filed complaint at

Doddaballapura town police station. PW2 denied the

suggestion that even eventhough motorcycle bearing

No.KA-43-L-6993 never caused the accident, some other

vehicle caused the accident, only to claim compensation,

after 3 days get filed a false complaint.

24. In the evidence affidavit PW3 to 5 Medical Record

officer of Columbia Asia Hospital, Medstar hospital and

Manipal hospital have produced case sheet and other

documents at Ex.P.38 to P.47.

25. Ex.P.4 is the copy of the FIR pertaining to crime

No.10/2019 registered by Doddaballapura town police

against the rider of motorcycle bearing No.KA-43-L-6993

for having committed offence punishable under Section

279,337 of IPC r/w 187 of IMV Act regarding causing of

injuries to Rajamma by dashing motorcycle bearing No.KA-

43-L-6993 on 28.01.2019 at 9.30 hours on the basis of

complaint presented by Siddagangaiah S/o.

Siddabommaiah.

26. Ex.P.5 is the copy of the complaint, Ex.P.6 is the

copy of spot mahazar recorded on 31.01.2019 , Ex.P.7 is

the copy of the vehicle seizure mahazar recorded on

04.02.2019. Ex.P.8 is the Motor Vehicle Accident Report

recorded on 06.02.2019. Ex.P.9 is the copy of the wound

certificate issued by Columbia Asia Referral hospital ,

Yeshwanthpura in which reason for the injury suffered by

Rajamma is noted as RTA near Muthyalamma temple ,

Jalappa college road, Doddaballapura. Ex.P.10 are the

copy of the statements of Gangamuthaiah, S/o.

Kemparangaiah, Ramesh, S/o. Hombanna,

Channarayappa, S/o. Eraiah, Panduranga, P.C. 1559

recorded by Investigation officer.

27. Ex.P.11 is the copy of the chargesheet filed by

Doddaballapura town police in crime No.10/2019 against

Pradeep H.N., S/o. Narayanaswamy for having committed

offence punishable under Section 187 of IMV Act, Section

279,338 of IPC .

28. Medical records shows that in the accident

deceased Rajamma suffered grievous head injuries , took

treatment at Columbia Asia Hospital, Yeshwanthpur from

28.01.2019 to 15.02.2019, Medistar hospital, Kodigehall

from 15.02.2019 to 23.02.2019, Reneu Life Physiotherapy

and Rehabilitation, Unit of Siddaganga Healthcare Center

at Nagarabhavi, Bengaluru from 23.02.2019 to

04.09.2019, Sri Dharmasthala Manjunatheshwara

Institute of Ayurveda and hospital, Kumbalagodu ,

Bengaluru 24.01.2021 to 07.02.2021.

29. Ex.P.39 is the copy of Medico legal register issued

by Manipal hospital , Yeshwanthpur in which appearance

of Rajamma with the history of RTA injury to head , taken

treatment at local hospital is mentioned. Ex.P.40 is the

copy of the police intimation dated 28.01.2019 forwarded

by Columbia Asia Hospital , Yeshwanthpura to PSI,

Malleshwaram police station. Ex.P.46 is the copy of the

police intimation dated 28.01.2019 forwarded by Medical

Officer of Columbia Asia clinic, Doddaballapura intimating

bringing of Rajamma with the history of RTA to SHO ,

Rural police station, Doddaballapura.

30. Copy of UDR No.32/2021 shows that on

23.09.2021 at 11.00 a.m. on the basis of the

report/information provided by B.G.Papaiah about the

death of Rajamma , PSI/ police inspector , Doddaballapura

Circle registered UDR No.32/21 and forwarded the same to

Addl. Civil Judge, JMFC Court , Doddaballapura.

Enclosure of UDR No.32/2021 is the copy of the inquest

mahazar recorded on 23.09.2021 and P.M.Report dated

23.09.2021. Third enclosure of UDR No.32/2021 is the

report dated 23.09.2021 forwarded by Police Inspector,

Doddaballapura circle, to Medical Officer , Govt. hospital ,

Doddaballapura seeking opinion about the reason for the

death of Rajamma.

31. Fourth enclosure is the report dated 25.04.2022

forwarded by PSI , Doddaballapura Circle to Addl. Civil

Judge, JMFC, Doddaballapura seeking to insert Section

304(A) of IPC in crime No.10/2019 of Doddaballapura town

police station which is pending for adjudication and to

continue the trial. The other enclosure of UDR No.32/2021

are the chargesheet filed by P.I., Doddaballapura circle in

crime No.10/2019 against Pradeep H.N., S/o. Narayana

swamy for having committed offence punishable under

Section 279,304(A) of IPC , Section 187 of IMV Act.

32. In this case respondents have not produced any

type of evidence to disbelieve the contents of police records

and medical records produced by the petitioners regarding

reason , mode and consequence of the accident and about

the reason for the death of Rajamma.

33. Hence, I have concluded that on 28.01.2019 at

about 9.30 a.m. when Smt.Rajamma about to cross

Kodigehalli road, near Muthyalamma temple,

Doddaballapura town to reach Anagalapura village ,

Pradeep H.N., S/o. Narayanaswamy, negligently rode

motorcycle bearing No.KA-43-L-6993 dashed the same to

Rajamma,thereby aused accident resulting in the grievous

injuries, who has been treated in various hospitals,

however, inspite of better treatment on 23.09.2021

succumbed to those injuries. Hence, I answer issue No.1

and Addl. Issue in the affirmative and issue No.2 in the

negative.

34. Issue No.3: In the evidence affidavit PW2

Papaiah stated that as on the date of accident Rajamma

being aged about 44 years , used to earn Rs.45,000/p.m.

by working as Asst. Teacher , Government Lower Primary

School, Anagalapura village, Doddaballapura taluk, used

to contribute entire income to the family.

35. In the written statement respondent No.2

insurance company denied the allegation regarding age,

occupation and income of the deceased Rajamma.

36. In the cross-examination, PW2 denied the

suggestion that as on the date of accident, his wife is aged

more than 50 years and never used to earn Rs.45,000./-

p.m. PW2 stated that in the pay slip marked at Ex.P.27

and P.28 date of birth of his wife is noted as 06.06.1975.

37. Medical bills shows that from the time of

accident till 23.09.2021 PW2 get treated his wife Rajamma

at various hospitals by spending approximately

Rs.22,24,406/-.

38. Under certificates marked at Ex.P.31, B.E.O. ,

Doddaballapura certified that regarding the treatment

provided to Rajamma , medical reimbursement has not

been paid to PW2 Papaiah. Salary particulars marked at

Ex.P.27 and P.28 and other documents shows that as on

the date of incident Rajamma used to earn Rs.39,321/-

p.m. (Basic Rs.37.900/- + DA Rs.1421/-) by working as a

Asst. Teacher, Government Lower Primary School,

Anagalapura village, Doddaballapura taluk. Hence, I have

calculated compensation under the head of loss of

dependency in the following terms:

Age of the deceased Rajamma as on the 44 years
date of accident –

Monthly income of deceased Rajamma as on – Rs.39,321/-
the date of accident
Add: 30% towards future prospects Rs.51,117/-
(Rs.39,321+11,796= 51,117)
Less : 1/ 3rd towards personal expenses of Rs.34,078/-
the deceased Rajamma (51,117 – 17,039/-
= 34,078)
Annual income of the deceased 34,078×12 Rs.4,08,936/-

Multiplier Applicable 14

Loss of dependency 4,08,936×14 Rs.57,25,104/-

39. Hence, I award Rs.57,25,104/- towards loss of

dependency. Rs.15,000/- towards loss of estate,

Rs.15,000/- towards funeral expenses , Rs.40,000/-

towards spousal consortium to petitioner No.1,

Rs.80,000/- towards parental consortium to petitioners

No.2 and 3 at the rate of Rs.40,000/- each, Rs.22,24,406/-

towards treatment charges, Rs.5,00,000/- towards

attendant, conveyance etc.,

40. As referred above, in this case compensation has

been calculated as if a death case i.e., Smt. Rajamma

expired on 23.09.2021. Hence, I came to the conclusion

that petitioners No.1(a) to (c) are entitle to receive

Rs.85,99,510/- with interest at 6% p.a.. from 23.09.2021

as compensation from the respondents.

41. In the written statement respondent No.2

insurance company admitted the subsistence of the policy

with respect to motorcycle bearing No.KA-43-L-6993 as on

the date of accident . In the file there are no evidence to

show that respondent No.1 owner of the motorcycle bearing

No.KA-43-L-6993 has violated any terms of the policy.

Hence, I came to the conclusion that the respondents being

the owner and insurer of the motorcycle bearing No.KA-43-

L-6993 are liable to pay compensation and an award is to

be passed directing the respondents No.1 and 2 to pay

compensation to the petitioners, Hence, I answer issue

No.3 accordingly and pass the following :

ORDER

The petition filed by PW2 B.G.Papaiah , on behalf of

B.S.Rajamma on 05.07.2019 under Section 166 of IMV Act

claiming compensation on behalf of Rajamma and after

23.09.2021 , date of death of Rajamma continued by

B.G.Papaiah, P.Dhanushree, P. Srinivas is hereby partly

allowed.

The respondents No.1 and 2 being the owner and

insurer of motorcycle bearing No.KA-43-L-6993 shall either

jointly or severally pay Rs.85,99,510/- with interest at

the rate of 6% p.a., from 23.09.2021 to petitioners

towards compensation.

The respondent No.2, being the Insurer of the

motorcycle bearing No.KA-43-L-6993 shall deposit the

compensation amount with interest within 4 months from

today.

The compensation amount and interest are distributed

among petitioners equally .

After deposit of the compensation amount, entire

compensation amount and interest allotted in favour of

petitioners No.1(a) to 1(c) may be released by crediting the

same to their respective bank accounts directly.

Advocate’s fee is fixed at Rs.1,000/- .

Draw an Award accordingly.
