1. Mr. Harshpal Sekhon, learned counsel
for the applicant.

2. Ms. Meenakshi Sharma, learned Brief
Holder for the State.

3. Present applicant-Dharamveer Gangwar
S/o Sohan Lal is seeking regular bail in
relation to first information report dated
07.06.2025, bearing FIR No.0268 of 2025,
Police Station Rudrapur, District Udham
Singh Nagar, wherein the present applicant
has been implicated for the offences
punishable under punishable 8/21 of the
NDPS Act.

4. It is contended by learned counsel for
the applicant that the applicant is innocent
and has been falsely implicated and the
alleged contraband, which is shown to be
recovered from the present applicant, is 133
gram of Smack, is a non-commercial quantity.

5. Learned counsel for the applicant
further submits that there is no substantial
compliance of Section 50, 52 and 57 of the
NDPS Act and the applicant has no previous
criminal history.

6. On the other side, Ms. Meenakshi
Sharma, learned Brief Holder for the State, on
instruction, apprise to this Court that the
alleged contraband, which is shown to be
recovered from the present applicant, is a
non-commercial quantity and he has no
previous criminal history, however, the
investigation is going on.

7. After hearing the arguments as
advanced by learned counsel for the parties
and further taking into consideration that the
alleged contraband, which is shown to be

recovered from the present applicant, is a
non-commercial quantity and the applicant
has no previous criminal history, therefore,
this Court is of the view that the applicant
deserves for bail.

8. Accordingly, without expressing any
opinion on the merit of the case, the present
bail application is allowed.

9. Let the applicant, namely,
‘Dharamveer Gangwar,’ be released on bail,
on his executing a personal bond and
furnishing two reliable sureties, each in the
like amount, to the satisfaction of the court
concerned.

10. It is made clear that after being
released on bail, the applicant shall
cooperate with the ongoing investigation,
failing which, the prosecution is directed to
move an application for cancelling the bail.
