Notice. Mr. Jitender Sharma, learned Additional

Advocate General appears and waives service of notice on

behalf of the respondent-State.

Reply, if any, be filed within a period four weeks.

The applicant/appellant was convicted and sentenced to

undergo rigorous imprisonment for a period of three years

and was directed to pay fine of ₹25,000/-(Rupees Twenty

Five Thousand) and in default of payment of fine to further

undergo simple imprisonment for a period of four months

for the commission of offence punishable under Section

120-B read with Section 420, 471, of IPC and Section 13(1)(d)

read with Section 13(2) of PC Act; to undergo rigorous

imprisonment for a period of three years and was directed to

pay fine of ₹10,000/-(Rupees Ten Thousand) and in default

of payment of fine to further undergo simple imprisonment

for a period of three months for the commission of offence

punishable under Section 467 of IPC; and to undergo

rigorous imprisonment for a period of three years and was

directed to pay fine of ₹10,000/-(Rupees Ten Thousand) and

in default of payment of fine to further undergo simple

imprisonment for a period of three months for the

commission of offence punishable under Section 468 of IPC

by learned Special Judge, (CBI), Shimla, District Shimla,

H.P., in Corruption Trial No. 18-S/7 of 2015 (Registration No.

900418 of 2015), dated 22.7.2025/28.7.2025.

Keeping in view the fact that the appeal is not

likely to be heard at the earliest as so many appeals are

pending for its disposal, therefore, operation and execution

of the substantive sentence of imprisonment imposed by

learned Trial Court is ordered to be suspended till further

orders, subject to his furnishing personal bond in the sum of

₹25,000/- with one surety in the like amount to the

satisfaction of learned trial Court and to deposit of the fine

amount, if not deposited earlier, with an undertaking to

appear and serve sentence, in case of dismissal of the

present appeal, within a period of one month from today. A

copy of this order be sent to the learned Trial Court for

information and necessary action.

The applicant/appellant is permitted to produce

copy of this order, downloaded from the Webpage of the

High Court of Himachal Pradesh before the authorities

concerned and the said authority shall not insist on the

production of a certified copy but if required, may verify

from passing of the order from website of the High Court of

H.P.

Learned Trial Court is directed to transmit the

bail bonds, so furnished by the applicant before it, for
